O objetivo da presente dissertação é investigar qual a resposta brasileira para os danos causados por pessoa com deficiência mental, considerando as alterações do Estatuto da Pessoa com Deficiência, que realizou grande revolução na teoria geral das incapacidades. Para tanto, na primeira parte, será investigada a teoria geral das incapacidades, em especial o conceito de incapacidade e de figuras assemelhadas, a inviabilidade de limitação da incapacidade absoluta, o critério de identificação da incapacidade relativa e os novos perfis da curatela. Em seguida, na segunda parte, após estudo da evolução histórica do instituto, serão abordados os critérios atuais de incidência do artigo 928 do Código Civil, decompondo a análise do artigo em itens diversos, envolvendo a prevalência da subsidiariedade, a natureza e fundamentos dessa norma, as hipóteses de irresponsabilidade do curador e os critérios para identificação da insuficiência patrimonial do responsável. Ademais, serão construídos critérios para a indenização equitativa, além de avaliadas as hipóteses de regresso do curador e do incapaz.

Abstract in English
The objective of this dissertation is to investigate the Brazilian response to damages caused by a person with mental disability, considering the changes made by the Statute of the Persons with Disability, which caused a revolution in incapacity doctrine. The first part of the dissertation discusses the incapacity doctrine, especially the concept of incapacity and similar legal constructs, the infeasibility of limiting absolute incapacity, the criteria for identifying relative incapacity, and new profiles of guardianship. Then, in the second part of the dissertation, after studying the historical evolution of this legal construct, the current criteria of incidence of Article 928 of the Civil Code will be addressed, decomposing the analysis of the article into several items, involving the prevalence of secondary liability, the nature and fundamentals of this rule, the hypotheses of irresponsibility of the guardian and the criteria for identification of the insufficient assets of the responsible party. Furthermore, this dissertation suggests criteria for equitable compensation and evaluates the regression actions of the guardian and the person without capacity.
