A pesquisa investigou os instrumentos urbanísticos limitadores ao direito de propriedade e seu papel na regulação da ocupação do solo urbano para o fim da habitação social, com especial enfoque para a usucapião coletiva, o direito de superfície e as Zonas Especiais de Interesse Social como instrumentos civis e urbanísticos úteis à ação voltada para o fim da habitação social. A reflexão jurídica em tela partiu da análise do direito de propriedade e suas limitações, considerando o direito à moradia e o direito à cidade, assim entendidos como o direito conferido aos habitantes da cidade de obterem acesso aos bens sociais e culturais por meio da garantia de moradia digna. Apresentou diversos instrumentos urbanísticos limitadores do direito de propriedade, suas características e peculiaridades. Por fim, ofereceu destaque à usucapião coletiva, ao direito de superfície e às Zonas Especiais de Interesse Social como potenciais instrumentos auxiliadores na garantia do acesso à moradia à população de baixa renda, assim como suas implicações no direito civil, com relação à limitação que oferecem ao direito de propriedade.

The research investigated the urbanistic instruments limiting the right to property and its role in the regulation of urban land occupation for the purpose of social housing, with special focus on "usucapião coletiva", "direito de superfície" and "Zonas Especiais de Interesse Social - ZEIS" as instruments of the law to support actions towards the goal of social housing. Legal reflection on the ground started from the analysis of property rights and their limitations, considering the right to housing and the right to the city, understood as the right of the inhabitants of the city to gain access to social and cultural goods through the guarantee of housing in good conditions. The research analyzed several urbanistic instruments limiting the right of property, their characteristics and peculiarities. Lastly, it emphasized "usucapião coletiva", "direito de superfície" and "Zonas Especiais de Interesse Social - ZEIS" as potential tools to guarantee the access to housing for the low income population, as well as its implications in the property rights, regarding the limitations they offer to these rights.
