O presente trabalho tem por objetivo o estudo do risco contratual, em especial na perspectiva da incorporação imobiliária. O trabalho encontra-se dividido em três partes. Nesses termos, na parte 1, procuramos delimitar o risco contratual e algumas de suas principais implicações aos negócios jurídicos. Na parte 2, realizamos a investigação de alguns instrumentos legais e convencionais que podem auxiliar os contratantes na melhor forma de gestão do risco contratual na atividade da incorporação imobiliária. Ao final, na parte 3, procuramos separar os principais riscos a que incorporador, proprietário do terreno e adquirente estão sujeitos, procurando delimitar a melhor forma de sua gestão e interpretação.

Abstract in English
The purpose of the present work is the study of contractual risk, especially in the perspective of real state development. The thesis is divided into three parts. In these terms, part 1 focus on delimiting contractual risk and some of its main implications into contracts. Part 2 investigates some of the legal and conventional instruments which may support contractors in achieving an efficient way of managing the contractual risk in the activity of real state development. At last, in part 3, the aim was to separate the major existing risks involving developers, owners and acquirers, in order to delimit the most effective way of its management and interpretation.
