A responsabilidade dos construtores por vícios e defeitos da construção, no Brasil, é uma questão complexa devido à falta de coerência do sistema legal e à sobreposição de várias normas, bem como em virtude da falta de clareza de algumas delas, resultando em um cenário crítico de insegurança jurídica, principalmente em relação aos prazos prescricionais e decadenciais aplicáveis. O objetivo do presente trabalho é esclarecer as controvérsias existentes que afetam tanto os profissionais que trabalham no setor da construção civil como os consumidores. A intenção é ir além do óbvio, traçando um paralelo com a lei e a doutrina estrangeiras. A responsabilidade dos construtores por defeitos de construção será analisada de acordo com o Código Civil brasileiro, considerando-se a disciplina da empreitada, dos vícios redibitórios e do inadimplemento. Em seguida, a questão será examinada no âmbito do Código de Defesa do Consumidor. Por fim, será abordado o tema dos vícios e defeitos da construção nos seguintes países: Alemanha, Espanha, França, Itália, Portugal, Austrália, Nova Zelândia e no Reino Unido.

Abstract in English
The responsibility of the builders for construction defects in Brazil is a complex issue due to the lack of coherence of the legal system, the superposition of several rules, and the lack of clarity of some of them, which result in a scenario of legal uncertainty, mainly on the limitations applicable. The objective of the present work is to clarify the existing controversies that affect both the construction industry professionals and its consumers. The intention is to go beyond the obvious, drawing a parallel with foreign law and doctrine. The liability of the builders for construction defects will be analyzed under the Brazilian Civil Code, facing the disciplines related to the work contract, the latent defects, and the breach of contract. Then, the issue will be analyzed within the scope of the Consumer Defense Code. Finally, the discipline of defects in constructions will be examined in the following countries: Germany, Spain, France, Italy, Portugal, Australia, New Zealand and in the United Kingdom.
