A dissertação analisa a concorrência desleal e outras formas de concorrência ilícita, como a concorrência sobre bases ilícitas, a concorrência ilícita stricto sensu e o antitruste, enfocando a responsabilidade civil decorrente desses ilícitos, com a análise dos requisitos de nexo causal, culpa (e sua dispensa no caso de abuso de direito) e dano. No que se refere ao dano, a dissertação analisa tanto o dano moral decorrente da concorrência ilícita, suas formas de reparação e critérios para quantificação da indenização, quanto o dano material, em especial, os lucros cessantes, verificando, nesse ponto, se há necessidade de efetiva comprovação ou se é possível presumir sua ocorrência, bem como quais são os parâmetros para cálculo da indenização devida. Por fim, a dissertação tratará do enriquecimento injustificado como forma de reação ao ilícito lucrativo, de forma conjugada com a responsabilidade civil

The thesis analyzes unfair competition and other forms of illicit competition, such as competition on illicit basis, unfair competition stricto sensu and antitrust, focusing on civil liability arising from these illicit acts, with the analysis of the requirements of causal link, fault (and its exemption in case of abuse of right) and damage. With regard to damage, the thesis analyzes the moral damage resulting from unlawful competition, its forms of reparation and criteria for quantification of compensation, and material damage, in particular, loss of profits, verifying at that point if there is a need of effective proof or if it is possible to presume its occurrence, as well as what are the parameters for calculating the indemnity due. Finally, the thesis will deal with unjustified enrichment as a form of reaction to the profitable wrong, in conjunction with civil liability
