O presente trabalho busca individuar, no decorrer do desenvolvimento da ciência jurídica nos séculos, no Ocidente, a linha construtiva da ideia de sistema jurídico, em particular de sistema jurídico romanista, na tensão entre ciência jurídica, prática do direito e estabilização do direito. A análise desagua, sucessivamente, nas codificações do XVIII e XIX século, com particular atenção às obras codificadoras de Andrés Bello, o jurista do Pacífico, e Augusto Teixeira de Freitas, o jurista do Atlântico Sul, cujos modelos propiciaram a formação de um direito latino-americano que reflete uma identidade jurídica continental.

The present work seeks to individute, along the development of legal science through the centuries in the West, the constructive line of the idea of legal system, particularly of a romanistic legal system, in the tension between legal science, legal practice and legal stabilization. The analysis ends up, successively, in the codifications of 18th and 19th centuries, with particular attention to the codifying works of Andrés Bello, the jurist of the Pacific, and Augusto Teixeira de Freitas, the jurist of South Atlantic, whose models provided for the forming of a latin american law which reflects a continental legal identity.
