Trata-se de tese sobre a possibilidade de se atualizar o regramento do fideicomisso no Brasil, visando a possibilitar novos arranjos sucessórios e a instrumentalização do trust no Direito brasileiro. Para isso, descreve-se a história do surgimento do fideicomisso e como ele foi positivado no Brasil, tanto no Código Civil de 1916 como no Código Civil de 2002. Descreve-se, também, o trust, principalmente sob a ótica da Convenção de Haia, indicando suas principais utilizações, surgimento nos países de common law, entre outras características. Finalmente, explicita-se que o fideicomisso pode ter seu regramento alterado, especialmente para passar a ser negócio contratual e inter vivos, flexível, não necessariamente sucessório, e com regras em conformidade com a Convenção, no que se relaciona à figura do trust, a possibilitar sua vinda para o País, com o aumento das possibilidades de planejamento sucessório, e o renascimento do fideicomisso como um importante instrumento no sistema.

This is a thesis on the possibility of updating the fideicomisso's rules in Brazil so that this legal institute may make possible new succession arrangements and instrumentalize the trust in Brazilian law, either for succession or other purposes. For this purpose, it describes the history of the emergence of the fideicomisso and how it was established in Brazil, both in the Civil Code of 1916 and in the Civil Code of 2002. It also describes the trust, mainly from the standpoint of the Hague Convention, indicating its main uses, its appearance in common law countries, among other characteristics. Finally, it explains that the fideicomisso may have its regulations changed, especially to become a contractual deal, flexible, not necessarily a succession institute, and with rules in accordance with the Hague Convention on trust. This will allow the trust to come to Brazil, the increase of the possibilities of succession planning, and the rebirth of the fideicomisso as an important instrument in the system.
