Esta pesquisa tem por objeto contratos existenciais e de lucro, dicotomia elaborada recentemente na doutrina brasileira. Investiga a natureza de tais categorias contratuais, seus traços distintivos, bem como as diferenças na intervenção judicial em tais tipos de avença. No capítulo inaugural, a investigação parte do exame de textos do criador da dicotomia, Antônio Junqueira de Azevedo, a fim de delinear os conceitos de contratos existenciais e de lucro. Essa análise, conjugada com textos acadêmicos supervenientes sobre o tema, serve para identificar os traços distintivos de tais contratos na teoria do negócio jurídico. Examina-se a causa final como ponto distintivo entre as categorias. O capítulo inclui um estudo sobre os limites da causa final como indicadora de interesses existenciais nos contratos, chegando-se à ideia de que qualquer avença pode deter, em sua execução, traços existenciais. No segundo capítulo, teorias sobre a eficácia horizontal dos direitos fundamentais foram utilizadas para delinear um guia de fundamentação e controle das intervenções judiciais nos contratos existenciais, o tipo essencialmente novo da dicotomia. Teses que concebem a regulação contratual de modo similar aos contratos existenciais e de lucro foram objeto de análise no terceiro capítulo, enriquecendo o trabalho com soluções aos problemas que a dicotomia brasileira propõe solucionar. Analisa-se no último capítulo como a intervenção judicial nos planos da validade e eficácia dos contratos muda em vista da natureza distinta de cada categoria em exame. A causa final e a cláusula geral da função social do contrato são os fios condutores da análise, traçando um iter analítico das situações jurídicas abarcadas pelas categorias acima, bem como dos limites e possibilidades de intervenção judicial nos referidos contratos.

The object of this research are existential contracts and profit contracts, a dichotomy recently elaborated in the Brazilian contractual doctrine. It investigates the nature of these contractual categories, its distinctive features, as well as differences in judicial intervention in such types of agreement. In the first chapter, the investigation starts from the analysis of texts by the creator of the dichotomy, Antônio Junqueira de Azevedo, to delineate the concepts of existential and profit contracts. This analysis, together with supervening academic texts on the matter, supports the identification of the categories' distinctive features in the contractual theory. The final cause is analyzed as a distinctive point between them. The chapter includes a study on the limits of the final cause as indicator of existential interests in contracts, coming to the idea that any contract can end up having existential traces in its performance. In the second chapter, theories on the horizontal effect of fundamental rights were used to delineate a reasoning guide that underlies and controls judicial interventions in existential contracts, the essentially new category of the dichotomy. Theories that conceive the contractual regulation in a similar fashion were examined in the third chapter, enriching this research with solutions to the problems the dichotomy proposes to solve. With the help of these theories, the last chapter examines how judicial intervention regarding validity and effectiveness of contracts differ in view of the nature of existential and profit contracts. The final cause and the general clause of the social function of contract serve as guiding threads for this chapter, helping to trace an analysis of the legal situations covered by the above categories, as well as the limits and possibilities for judicial intervention in said contracts.
