O presente estudo busca descrever os casos de direito de retenção no campo do direito privado para, em seguida, revelar os pontos comuns das várias situações estudadas, definindo o regime jurídico do direito de retenção no direito brasileiro. Apresentados os casos e o regime geral, o trabalho apresenta proposta de alteração legislativa para a criação de um capítulo destinado a regulamentar em termos gerais o direito de retenção.

This study seeks to describe the cases of retention rights in the field of private law and then reveal the common points of the various situations studied, defining the legal regime of retention rights in Brazilian law. Having presented the cases and the general regime, the work presents a proposal for a legislative amendment to create a chapter aimed at regulating in general terms the right of retention.
