Concebidas simultaneamente ao desenvolvimento contínuo da tecnologia na sociedade contemporânea, as modernas práticas de engenharia genética e demais biotecnologias ganham revelo em função de aplicação nos diversos setores da indústria e agricultura, revelando ascendentes pesquisas desenvolvidas para aperfeiçoamento das técnicas e ampliação de aplicabilidade. Os benefícios são amplamente divulgados e de igual forma, são conhecidas as possibilidades de riscos de efeitos negativos, no que se refere a potenciais impactos irreversíveis ao meio ambiente. Com relação a estes novos danos, biotecnológicos, o atual estado da técnica não permite precisá-los em alguns casos, pois desconhecidos os resultados advindos de certas biotecnologias. Neste escopo, considerando que a biotecnologia é desenvolvida em propriedades, ou nestas aplicadas, revertendo-se em proveito útil ao proprietário e que, o direito de propriedade não pode ser equivalente a licença para poluir, mas exatamente o contrário disso, a propriedade deve atender sua função socioambiental e o proprietário, precisa entregar para a sociedade, o cumprimento de seu dever ativo de segurança e zelo pela proteção dos bens ambientais no imóvel, este trabalho procurou, ponderando a salvaguarda do exercício do direito de propriedade coadunado à biossegurança como tutela preventiva do meio ambiente, delimitar bases de fundamentação jurídica para compelir o proprietário a adotar a biossegurança e impedir a escusa de inexistir legislação própria que atrele exercício do direito propriedade e o dano biotecnológico potencial. Para tanto, estudamos temas como tutela constitucional do meio ambiente, biossegurança, função socioambiental da propriedade, dano e nexo causal, com o escopo de orientar o direcionamento das condutas humanas para adoção de postura precaucionista como garantia da preservação ambiental.

Conceived simultaneously with the continuous development of technology in contemporary society, modern genetic engineering practices and other biotechnologies are gaining prominence due to their application in various sectors of industry and agriculture, revealing ascendant researches developed to improve techniques and expand their applicability. The benefits are widely publicized and, likewise, the possibilities of risks of negative effects are known, with regard to potential irreversible impacts on the environment. Regarding these new biotechnological damages, the current state of the art does not allow us to specify them in some cases, as the results arising from certain biotechnologies are unknown. In this scope, considering that biotechnology is developed on properties, or applied to them, reverting to the useful benefit of the owner and that the property right cannot be equivalent to a license to pollute, but exactly the opposite, the property must meet its socio-environmental function and the owner, needs to deliver to society, the fulfillment of its active duty of safety and zeal for the protection of the environmental assets in the property, this work sought, considering the safeguard of the exercise of the property right combined with biosafety as preventive protection of the environment, delimit legal bases to compel the owner to adopt biosafety and prevent the excuse of not existing own legislation linking the exercise of the property right and the potential biotechnological damage. Therefore, we study themes such as constitutional protection of the environment, biosafety, the social and environmental function of property, damage and causal link, with the scope of guiding the direction of human conduct to adopt a precautionary posture as a guarantee of environmental preservation.
