Esta dissertação tem como tema a revisão judicial dos contratos no sistema de defesa do consumidor no que concerne ao sinalagma funcional. Inicialmente, faz-se necessária uma retrospectiva sobre a alteração das circunstâncias contratuais desde o Direito Romano, passando-se pela Idade Média, pelas modernas doutrinas, sobretudo na Alemanha, na Itália e na França, as quais tiveram forte influência para o desenvolvimento da alteração das circunstâncias no Direito Brasileiro. Na sequência, são delineados os princípios informadores do Código Civil e do Sistema de Defesa do Consumidor, com a descrição e a análise de suas respectivas formas de atuação para revisar os contratos em virtude da alteração superveniente do equilíbrio econômico. Para o Sistema de Defesa do Consumidor, basta a comprovação da onerosidade excessiva, ao contrário do Código Civil, o qual requer a comprovação da extraordinariedade e a imprevisibilidade. Em continuidade, são analisadas a definição de consumidor e as espécies de revisão consumerista. Na casuística, destaca-se o caso do leasing cambial, bem como a distribuição de riscos nos contratos bancários de concessão de crédito. Por fim, é objeto de estudo a possibilidade de revisão judicial nos casos de superendividamento do consumidor, nos contratos existenciais e interempresariais e também nos contratos relacionais.

The subject matter of this dissertation is the judicial review of contracts in the consumer protection system with regard to functional bilateral contract. Initially, it is necessary a retrospective regarding the alteration of the contractual circumstances since the Roman Law, going through the Middle Ages, the modern doctrines, especially in Germany, Italy and France which had a strong influence in the development of the alteration of the contractual circumstances in Brazilian Law. Following, the informative principles of the Civil Code and the Consumer Protection System were outlined with the description and analysis of their respective forms of performance to review the contracts due to the alteration supervened from the economic balance. For the Consumer Protection System, the evidence of excessive burden is enough, unlike the Civil Code, which requires evidence of the extraordinary nature and unpredictability. Following, the definition of consumer and species of consumerist review were analyzed. In this series, the case of foreign exchange leasing stood out, as well as the distribution of risks in banking contracts of granting of credit. Finally, the possibility of judicial review in cases of consumer overindebtedness, in the existential and cross-company contracts and also in relational contracts were the object of study.
