Este trabalho tem como objeto revisar criticamente os fundamentos legais e principiológicos da responsabilidade civil ambiental no Brasil e os deveres impostos aos titulares de bens imóveis de interesse socioambiental. A partir da revisão dos princípios e dos fundamentos legais que impõem deveres e responsabilidades aos titulares de bens imóveis socioambientais, o trabalho visa responder se é possível reconhecer positivamente titulares de bens imóveis que ajam de forma benéfica ao meio ambiente, como forma de aplicação do princípio da precaução, no campo da responsabilidade civil. A análise também passa pela identificação dos interesses juridicamente tuteláveis a partir da violação de um dever de preservação de interesse ambiental ou da causação de um dano ambiental. O trabalho adota como casuística central a transferência de titularidade de um bem imóvel, por entender que tal contexto permite diferenciar os deveres e responsabilidades entre diferentes pessoas, em especial o caráter real (propter rem) dos deveres de preservação e recuperação de áreas protegidas e o dever de indenizar outros interesses juridicamente tuteláveis decorrentes de um evento danoso.

This work aims to critically review the principles and legal foundations of environmental civil liability in Brazil, in particular on the duties imposed on the owners of real estate with environmental interest. Based on a review of the principles and legal foundations that impose duties and responsibilities upon the owners of social-environmental real estate, the work aims to answer whether it is possible to identify, in the Brazilian legal system, hypotheses for recognizing the behaviors of owners of environmental goods that are beneficial to the environment, when compared to unwanted behaviors, providing alternatives to the application of punitive damages upon the owners as the sole possible consequence of the effectiveness of precautionary principle. The analysis also involves the identification of legally recognized interests based on the violation of an environmental duty. The work adopts as a central case series the transfer of ownership of a real estate, as it understands that this context better allows to differentiate the duties and responsibilities between different subjects, especially the property aspect (propter rem) of the duties of preservation and recovery of protected areas and the duty to indemnify other legally recognized interests.
