Analisa-se a possibilidade dogmática de se conceber uma responsabilidade preventiva. Gravitando em torno do exame estrutural do ato ilícito, depurado pela revisão de seus elementos sob a influência da doutrina penal, em especial, da teoria da imputação objetiva, filia-se a uma corrente que, no escopo de atender à demanda social por maior proteção, prescinde do dano fenomênico e acentua a análise da tolerabilidade social do risco como gatilho para a nova formulação dogmática. Atenta-se, contudo, para a ilusão do risco zero, para a necessidade de se ponderar interesses conflitantes e para os limites da máxima latina do neminem laedere. A partir desses dados, constrói-se um modelo que procura complementar o instituto da responsabilidade em sua formatação tradicional e operacionalizar uma nova função do mesmo, a função preventiva de eficácia ex ante.

We analyze the dogmatic possibility of conceiving a preventive liability. The starting point is the structural examination of the illicit act, refined and revised under the influence of the criminal law doctrine, specifically the theory of objective imputation. This proposition dispenses the concrete damage and emphasizes the analysis of the social tolerance of risk as a trigger for the new dogmatic formulation, thus answering society's rising demand for greater legal certainty and protection. Special attention is given to the illusion of zero risk, to the need of pondering about conflicting interests and to the limits of the Latin maxim of the neminem laedere. From this data, it is possible to build a model that seeks to complement the institute of tort law in its traditional formatting, as well as operationalizing a new purpose: the preventive function with anticipatory efficacy.
