O presente trabalho se destina a analisar os diversos aspectos do direito à vida, mas digna (ou o direito à morte, quando a vida deixa de ser digna, o que envolve o direito de morrer com dignidade), enquanto direito da personalidade, e suas implicações jurídicas, notadamente no que diz respeito à eutanásia e à ortotanásia, ao lado da viabilidade do instrumento chamado de Diretivas Antecipadas de Vontade (Diretivas Escritas ou "Testamento Vital" e Procuração para Cuidados de Saúde), para culminar em uma proposta para regulamentação da matéria por lei.

The present work is intended to analyze the various aspects of the right to life, but to a dignified life (or the right to die, when life stops being dignified, which involves the right to die with dignity), as a personality right, and its legal implications, notably with regard to euthanasia and orthotanasia, alongside with the feasibility of the instrument called Advanced Directives (Living Will and Durable Power of Attorney), to culminate in a proposal for regulation of the matter by law.
