Este estudo tem por objeto a análise do contrato de administração de locação de imóveis visando sua qualificação e estabelecimento da natureza e regime jurídicos. Para tanto, parte-se do raciocínio lógico que o operador do direito se utiliza, recorrendo ao pensamento subsuntivo, tipológico e a causa concreta para a atividade de qualificação de qualquer contrato. Envereda-se então, com base na operação econômica, à apreensão dos tipos que lhe são próximos e referidos na doutrina e jurisprudência quando instados a tratar e decidir sobre o tema, para aferir se qualquer deles tem elasticidade suficiente a abarcar relação jurídica em tela. Apenas após demonstrar que a administração de imóveis extrapola estes tipos, é que se passa à sua qualificação, como contrato de tipo social próprio que, muitas vezes, é estabelecido em conexão com a corretagem, para concluir quanto ao regime jurídico que lhe é aplicável e sua relação com o contrato de locação a que se refere.

This study aimed to analyze the property rental management contract seeking its qualification and establishing the legal nature and regime. In order to do so, it is part of the logical reasoning that the operator of the law uses, appealing to the subsonic thought, typologic and the concrete cause for the qualification activity of any contract. It is then engaged, based on the economic operation, the apprehension of the types that are close to him and referred in the doctrine and jurisprudence when urged to treat and decide on the subject, to verify if any of them has enough elasticity to include juridical relation in the screen. Only after showing that the property rental management goes beyond these types, it is going to its qualification, as a social contract of its own that, often, is established in connection with brokerage, to conclude on the legal regime that is applicable to it and its relationship with the property rental management contract referred to.
