Esta tese objetiva propor uma diferente reflexão sobre a caracterização jurídica do direito de arena no Brasil. Por intermédio de sua investigação histórico-legislativa, verifica-se que o direito de arena é instituto genuinamente brasileiro, notadamente em razão de sua previsão constitucional. Mediante o estudo do direito estrangeiro, em exemplos do Uruguai e da França, constatam-se possíveis referências para que se possa estudar o conceito de imagem coletiva, em diálogo com o direito de arena brasileiro. Em face do exposto, é analisada a necessidade de alteração legislativa a respeito da regulação do direito de arena no Brasil, ultrapassandose sua tutela presente na Lei 9.615/1998, a fim de proteger os participantes do espetáculo desportivo da forma como disposto na Constituição de 1988. Nossa proposição enaltece, ainda, peculiar natureza jurídica híbrida ao direito de arena, buscando apresentar suas respectivas delimitações, ao se identificarem aproximações e distanciamentos do direito de imagem puro.

Abstract in English
This thesis aims to propose a different reflection on the legal characterization of the Arena Rights in Brazil. Through an historical and legislative investigation, we will conclude that the Arena Rights is genuinely a Brazilian institute, notably, in virtue of its constitutional nature. Furthermore, by investigating the Foreign Law, we will point out that Uruguay and France are possible examples to refer to when it comes to the understanding of the concept of the collective image, in dialogue with the Brazilian Arena Rights. In light of this, we will verify the need of a legislative modification concerning the regulation of the Arena rights in Brazil, by surpassing its protection, which is laid down in the Law 9.615/1998, in order to protect the participants of the sport spectacle, as well as it is provided by the Constitution of 1988. The proposition of this study will also highlight the legal nature of the Arena Rights as hybrid, and it will pursue to suggest their respective delimitations, by noticing approximations and distances to the image right merely.
