O museu exerce função paradoxal. Ao adquirir obra de artes plásticas, ele tem o papel de comunicar essas criações e, concomitantemente, a missão de preservá-las e de conserválas. Para sobreviver e exercer suas obrigações primordiais, deve-se levar em conta que essas instituições são afetadas pela lei de direitos autorais. Está-se diante de relação jurídica entre o museu, o autor de artes plásticas e a própria obra intelectual, presente no acervo do museu. Esta tese sugere modificação da lei de direitos de autor a fim de considerar a função comunicativa do museu público brasileiro. Esta tese almeja contribuir de forma original com o seu campo de conhecimento e, para tanto, serão utilizadas referências do direito estrangeiro, quais sejam o direito alemão e o direito francês.

Abstract in German
The museum exercises a paradoxical function. By purchasing fine arts, the museum exercises the function of communication of these creations; and, simultaneously, has the mission to preserve and to conserve them. In order to survive and to exercise its functions, it should be taken into account that the Authors' Rights Law affects museums. According to our hypothesis, we suggest a modification of the Authors' Rights Law, in order to consider the communicative function of the Brazilian public museum. In order to reach our proposal, by providing an original contribution to our field of knowledge, we will examine the respective German Law and French Law.
