O presente trabalho aborda a responsabilidade civil sob a perspectiva daquele que realiza a atividade empresarial de intermediação entre usuário-motorista e usuário-passageiro, além de terceiros envolvidos diretamente com o uso da ferramenta de tecnologia, fazendo uma análise das leis que regulamentam os aplicativos de taxis. O objetivo desta dissertação é esclarecer os parâmetros de responsabilidade civil entre usuário-passageiro e usuário-motorista e terceiros quanto ao uso do aplicativo eletrônico, com investigação da aplicação das fontes legais. O trabalho analisa os contratos, e verifica como estes se comportam sob a perspectiva da responsabilidade civil contratual e extracontratual nos aplicativos que intermediam as relações entre contratante e contratado. É verificada, além disso, a questão de coexistir a teoria fundada em culpa e a teoria do risco da atividade com aplicações distintas nos contratos de intermediação eletrônica. A conclusão que se chega é de que o tema merece revisão legislativa para clarear a responsabilidade civil e as obrigações dos que exploram a atividade de intermediação, ao passo que, na continuidade e ausência de uma norma apropriada, a aplicação do direito tornar-se-ia árdua aos operadores do direito e deveras impossível para o cidadão compreender os limites e responsabilidades dos envolvidos, contribuindo com o aumento da iniquidade de julgados e com a desinformação legal.

The present work addresses the civil liability from the perspective of the one who performs the business activity of intermediation between user-driver and user-passenger, in addition to third parties directly involved with the use of the technology tool, making an analysis of the laws that regulate the applications of taxis. The purpose of this dissertation is to clarify the parameters of civil liability between userpassenger and user-driver and third parties regarding the use of the electronic application, with investigation of the application of legal sources. The work analyzes the contracts and verifies how they behave from the perspective of contractual and non-contractual civil liability in the applications that mediate the relations between contractor and contractor. In addition, the issue of coexisting the fault-based theory and the activity risk theory with different applications in electronic intermediation contracts is verified. The conclusion reached is that the issue deserves legislative revision to clarify the civil liability and the obligations of those who exploit the activity of intermediation, whereas, in the continuity and absence of an appropriate norm, the application of the law will become it was arduous for the operators of the law and indeed impossible for the citizen to understand the limits and responsibilities of those involved, contributing to the increase in the iniquity of judges and to legal disinformation.
