O presente estudo propõe a análise da proteção das criações de moda à luz dos direitos intelectuais, pelos regimes de direito do autor e de desenho industrial. Busca-se determinar a essência das criações de moda, as particularidades da sua natureza, bem como do objeto tutelado tanto pelo direito de autor, quanto pelo desenho industrial e, ainda as situações de concorrência desleal do design de moda. Pretende-se, também, verificar a viabilidade de cumulação dos regimes de proteção e, se o caso, em quais condições

The present study proposes the analysis of the protection of fashion creations under the prism of intellectual rights, especially based on the copyright and industrial design protection regimes. The goal is to determine the essence of fashion creations, considering the particularities of their nature, as well as the object protected by both copyright and industrial design, as well as situations of unfair competition in fashion design. It is also intended to verify the feasibility of cumulative protection and, if appropriate, under what conditions
