As modernas relações entre médico e paciente adquiriram relevância para o direito. Entretanto, especialmente na jurisprudência, é possível notar um estudo ainda incipiente do assunto. Dessa forma, acabam submetidas a regulamentos, resoluções e decisões do Conselho Federal de Medicina e seus semelhantes, de alguma forma, aparte do mundo jurídico. Todavia, o direito não pode ignorar tais relações, e vem sendo chamado, cada vez mais, a resolver complexos casos que envolvem o comportamento do médico, a informação dos pacientes, o consentimento informado e, principalmente, a relação jurídica formada entre eles. Neste sentido, a teoria das relações contratuais fáticas pode representar uma forma de tratamento de alguns destes cada vez mais complexos casos que se apresentam para o direito. Autores como GÜNTER HAUPT, e KARL LARENZ desenvolveram obras referência nesse assunto, sendo os pioneiros do desenvolvimento da teoria das relações contratuais de fato, com a adoção do comportamento social típico como ponto central dessas relações. Por outro lado, foi na Itália que a doutrina das relações contratuais fáticas encontrou campo fértil de aplicação, com grande relevância nos dias atuais, inclusive ao se falar nas relações médico-paciente. Assim, o presente trabalho, pretende aplicar a teoria das relações contratuais fáticas nas relações entre médico e paciente no Brasil, utilizando o precedente estrangeiro e o desenvolvimento da doutrina.

The modern doctor-patient relationship has acquired relevance for the right. However, especially in jurisprudence, it is possible to note a still incipient study of the subject. In this way, they end up submitted to regulations, resolutions and decisions of the Federal Medical Council and their fellows, somehow, apart from the legal world. However, law can not ignore such relationships, and is being increasingly called upon to solve complex cases involving physician behavior, patient information, informed consent and, above all, the legal relationship formed between them. In this sense, the theory of non-contractual relations may represent a form of treatment of some of these increasingly complex cases that appear to the right. Authors like GÜNTER HAUPT and KARL LARENZ have developed reference works on this subject, pioneering the development of contractual relations theory in fact, with the adoption of typical social behavior as the central point of these relations. On the other hand, it was in Italy that the doctrine of non-contractual relationships found fertile field of application, with great relevance in the present day, even when talking about the doctor-patient relations. Thus, the present work intends to apply the theory of contractual relations in the relations between doctor and patient in Brazil, using the foreign precedent and the development of the doctrine.
