A presente tese trata da tipicidade contratual em direito romano nos casos envolvendo a locatio conductio e outros tipos contratuais. Por causa da grande variedade de modelos negociais que poderiam ser estruturados pela locatio conductio, ela é paradigma importante para se discutir tipicidade contratual e tutela processual em direito romano. A pesquisa pretende analisar a locatio conductio do ponto de vista processual e material, de modo que seja possível compreender melhor o panorama jurídico no qual o debate está inserido.

The present thesis discusses typical contracts in Roman law in relation of 'locatio conductio' and other kinds of contracts. Because of the wide variety of 'business agreements' that could be structured by the 'locatio conductio', it is an important paradigm for discussing contractual kinds of contracts and procedural protection in Roman law. The research intends to analyze the "locatio conductio" from the procedural and material point of view, so that it is possible to better understand the juridical panorama in which the debate is inserted.
