A tese aborda o tema da ponderação no Direito Civil brasileiro. Faz-se observando a estrutura inicial da ponderação, construída como uma fase dentro da proporcionalidade, oriunda do Direito Administrativo da Prússia e do Direito Constitucional alemão. Explica essa construção e a atualidade do seu uso. Posteriormente, faz um cotejo com o modo como a Civilística nacional incorporou o tema, traçando paralelos e diferenças, tendo como modelo comparativo a sua concepção originária. Constata que a ponderação no Direito Civil brasileiro se aproxima de um uso não-jurídico do conceito e que não corresponde àquilo que alega ser. Avalia, por fim, os problemas de premissa da incorporação brasileira, tendo como foco duas importantes fragilidades teóricas apresentadas, a saber, (i) a adesão a uma premissa de que regras e princípios são normas qualitativamente distintas, (ii) as críticas infundadas ao positivismo e a promoção de uma suposta superação da subsunção. Finaliza argumentando que a ponderação não se mostra, sob a perspectiva técnica, como uma necessidade do Direito Civil, cogitando o seu uso apenas em caráter excepcional.

The thesis addresses the topic of balancing in Brazilian Civil Law. It does so by observing the initial structure of balancing, constructed as a phase within the proportionality, originating from Prussian Administrative Law and German Constitutional Law. Explains this construction and the current use of it. After that, it makes a comparison with the way in which national Private Law literature incorporated the theme, drawing parallels and differences, using its original conception as a comparative model. It finds that the consideration in Brazilian Private Law approaches a non-legal use of the concept and that it does not correspond to what it claims to be. Finally, it evaluates the premise problems of Brazilian incorporation, focusing on two important theoretical weaknesses presented, namely, (i) adherence to a premise that rules and principles are qualitatively distinct norms, (ii) unfounded criticisms of the positivism and the promotion of a supposed overcoming of subsumption. It ends by arguing that balancing does not appear, from a technical perspective, to be a necessity of Private Law, considering its use only on an exceptional basis.
