A presente tese de doutorado busca demonstrar que o direito brasileiro admite a extinção de certos contratos, notadamente os de execução não imediata, por justa causa, a despeito de não possuir em seu direito positivo qualquer referência específica a esta categoria jurídica. Também faz parte dos propósitos da tese (i) demonstrar que esta hipótese se estrutura dogmaticamente sob a figura da resilição, apresentada no Código Civil no artigo 473; e (ii) identificar dogmaticamente seu âmbito de operação, seu requisito de aplicação e a irradiação de efeitos que sua aplicação impõe à relação contratual.

Abstract in English
The present thesis aims to demonstrate that the Brazilian law system admits the extinction of a kind of contract, specifically the ones of non-immediate execution, for compelling reasons, despite the lack of reference of the textual law of this category. They are also purposes of this thesis: (i) to demonstrate that this legal category falls within the termination modality prescribed on art 473 Civil Code; and (ii) to identify its operational framework, its application criteria and how its effects affect the contractual relationship.
