O seguro de responsabilidade civil é extremamente relevante como instrumento de proteção, e o âmbito de sua cobertura enfrenta desafios constantes diante dos novos riscos a que a sociedade está sujeita. O objetivo da presente tese é traçar os principais aspectos relacionados ao contrato de seguro de responsabilidade civil facultativo, sua evolução normativa, natureza jurídica e conceito, à luz da legislação securitária, tanto no âmbito civil como no âmbito regulatório, para então, tratar, brevemente, de algumas das suas principais modalidades como o seguro de responsabilidade civil geral, o seguro de responsabilidade civil profissional (E&O), e o seguro para executivos e administradores (D&O), além de discorrer acerca de algumas das principais polêmicas relacionadas aos seguros de responsabilidade civil, de forma geral, entre as quais, destacam-se: o conceito de sinistro; o descumprimento pelo segurado de seus deveres; a vedação legal do segurado transacionar com o terceiro sem a anuência da seguradora; o pagamento da indenização ao terceiro prejudicado e a inexistência de relação entre a seguradora e o terceiro; a possibilidade do exercício de sub-rogação e contra quem ela será exercida; a prescrição da pretensão do segurado em face da seguradora e a do terceiro para com o segurado; além de discussões envolvendo coberturas e exclusões, diante dos riscos cibernéticos e dos novos tipos de dano. Considerando a intensa litigiosidade que permeia o tema, a tese aborda, também, algumas discussões processuais acerca da inexistência de relação jurídica entre a seguradora e o terceiro prejudicado, no tocante à ação direta e à denunciação da lide, além da possibilidade de os conflitos serem dirimidos por arbitragem. Ao final, são analisados os dispositivos que tratam do tema no projeto de lei de seguros em trâmite no Senado Federal (PLC nº 29/2017) e, propõe-se algumas alterações pontuais em dispositivos constantes no Código Civil.

Civil liability insurance is extremely relevant as a protection instrument, and the scope of its coverage faces constant challenges in view of the new risks to which society is subject. The purpose of this thesis is to outline the main aspects related to the civil liability insurance contract, its normative evolution, legal nature and concept, in the light of the security legislation, both in the civil scope and in the regulatory scope, and then to deal briefly with some of its main modalities such as general civil liability insurance, professional liability insurance (E&O), and insurance for directors and officers (D&O), in addition to discussing some of the main controversies related to civil liability insurance, in general, among which are: the concept of loss; the non-compliance by the insured of his duties; the legal prohibition of the insured to transact with the third party without the consent of the insurer; the payment of compensation to the third party injured and the inexistence of relationship between the insurer and the third party; the possibility of the exercise of subrogation and against whom it will be exercised; the Statute of Limitations of the claim of the insured against the insurer and that of the third party towards the insured; as well as discussions involving coverage and exclusions, in view of the cybernetic risks and the new types of damage. Considering the intense litigation that encompasses the subject, the thesis also addresses some procedural discussions about the inexistence of legal relationship between the insurer and the third party injured, regarding direct lawsuit and third party action, besides the possibility of conflicts being solved by arbitration. Finally, the regulation that deals with this issue is analyzed in the insurance bill of law is currently being processed by the Federal Senate (PLC nº 29/2017), and the thesis suggests some specific changes in current rules in the Civil Code.
