Portugal foi uma grande potência ao longo de séculos desde sua fundação, tendo seu Direito sido herdeiro do processo da Reconquista e das compilações bárbaras de direito romano, consolidandose, sob certo aspecto, já no fim do medievo, e tendo sido compilado nas Ordenações Afonsinas (1446), num texto que se repetiu nas Ordenações Manuelinas (1512) e Filipinas (1603) e acabou por vigorar até o século XIX em Portugal e XX no Brasil com aplicação muito diversa de sua origem, e por juristas igualmente distintos. Para a compreensão da longevidade deste Direito e de como o Portugal católico da reconquista tornou-se o Portugal oitocentista, é necessário buscar, em sua história, o momento central desta mudança no espírito do Reino, o qual consiste na obra reformista feita no reinado de D. José, pelo ministério de Sebastião José de Carvalho e Melo, o Marquês de Pombal. Desse modo, a presente dissertação busca compreender as reformas feitas pelo Marquês de Pombal na formação dos juristas e como elas conectam o Portugal antigo àquele que encerrou o século XVIII, analisando-se as fontes primárias destas reformas neste âmbito a Lei de 18 de agosto de 1769 (Lei da Boa Razão) e os Estatutos de 1772 da Universidade de Coimbra, dentre outros textos da época. Esta análise será feita à luz da própria História de Portugal, a qual leva a uma leitura contextualizada daquilo que era almejado pelo Marquês de Pombal e permite superar determinados lugares-comuns na interpretação do período pombalino. Assim, ao final, se chegará à conclusão de que o reformismo pombalino buscava retomar a grandeza portuguesa e Pombal, a rigor, não pode ser encaixado facilmente na figura de um anticlericalismo à francesa, por todo o seu contexto.

Portugal has been a great power for centuries since its founding, with its Law being heir to the Reconquest process and the barbarian compilations of Roman law, consolidating itself, in a certain way, already at the end of the Middle Ages and having been compiled in the Alfonsine Ordinances ( 1446), in a text that was repeated in the Manueline Ordinances (1512) and the Philippines (1603) and ended up being in force until the 19th century in Portugal and the 20th in Brazil with an application very different from its origin, and by equally distinguished jurists. In order to understand the longevity of this Law and how the Catholic Portugal of the reconquest became Portugal in the 19th century, it is necessary to seek, in its history, the central moment of this change in the spirit of the Kingdom, which consists of the reformist work carried out in the reign of D. José, by the ministry of Sebastião José de Carvalho e Melo, the Marquis of Pombal. Thus, this dissertation seeks to understand the reforms made by the Marquis of Pombal in the formation of jurists and how they connect ancient Portugal to that which ended the 18th century, analyzing the primary sources of these reforms - the Law of 18 August of 1769 (Law of Good Reason) and the Statutes of 1772 of the University of Coimbra, among other texts of that time. This analysis will be carried out in the light of the History of Portugal itself, which leads to a contextualized reading of what was desired by the Marquis of Pombal and allows overcoming certain commonplaces in the interpretation of the Pombaline period.
