O trabalho debate a utilização deliberada da usucapião, para substituir a formalização das transmissões imobiliárias, como meio de fraudar a disciplina do parcelamento do solo. Inicialmente, é traçado um panorama geral da usucapião, em que se destaca seu importante papel na regularização de imóveis, aspecto presente em diversas fases do desenvolvimento histórico do instituto. A avaliação dos elementos da categoria da usucapião permite identificar que os debates sobre a possível fraude ao parcelamento devem se dar no entorno do pressuposto da res habilis. Em seguida, são avaliadas as contribuições da jurisprudência dos tribunais superiores, para a compreensão do problema da usucapião de imóveis indevidamente parcelados. Com estas bases, são avaliados os aspectos gerais da fraude à lei e como ela se aplicaria à usucapião, oportunidade em que é sugerida uma solução conciliatória para viabilizar o reconhecimento da aquisição. Ao final, são avaliados os quatro meios processuais de reconhecimento da usucapião, a regularização fundiária urbana e rural e os processos judicial e extrajudicial, para verificar se a solução proposta pode ser viabilizada.

The paper discusses the deliberate use of usucapion, to replace the formalization of real estate transmissions, as a means of defrauding the land parceling discipline. Initially, an overview of the usucapion is outlined, highlighting its important role in the regularization of real estate, an aspect present in various phases of the institute's historical development. The evaluation of the elements of the category of usucapion allows us to identify that the debates about the possible installment fraud should take place around the assumption of res habilis. Then, the contributions of the jurisprudence of the superior courts to the understanding of the problem of the misappropriation of unduly parceled properties are evaluated. On this basis, the general aspects of fraud to the law and how it would apply to usucapion are evaluated, in which case a conciliatory solution is suggested to enable the recognition of the acquisition. In the end, the four procedural means of recognizing the usucapion, the urban and rural land regularization and the judicial and extrajudicial processes are evaluated to verify if the proposed solution can be made viable.
