O presente estudo propõe uma nova visão acerca do direito à identidade. Normalmente a identidade era observada apenas pela ótica dicotômica estática-dinâmica. A ideia é que ela passe a ser observada por outro prisma: identidade-identificação e identidade-percepção. É algo que se coaduna com a noção de falsa luz que os direitos italiano e norte-americano adotam. A primeira, de conteúdo mais simples, é marcada pelas noções de mesmidade e ipseidade, ou seja, a possibilidade de que alguém seja sempre identificado a partir de determinadas características, independentemente do tempo e do espaço. São exemplos dela, expostos no trabalho, o nome, a identidade sexual, a identidade genética, a identidade digital, subdividida em perfis e avatares, e a identidade nacional. A segunda, por sua vez, de conteúdo mais complexo, contempla vários pressupostos. Trata-se de uma visão de mundo construída a partir de um processo dialógico, marcada por uma narrativa e que se estabelece em uma estrutura que deve ser ética para poder ser tutelada. São exemplos as identidades racial, de gênero, política, religiosa e intelectual. Por se tratar de um direito da personalidade relativamente recente, deve ser diferenciado de outros que lhe são correlatos, como os direitos à imagem, à honra e à privacidade. Além disso, suas características precisam ser compreendidas e suas formas de tutela analisadas, tais como a autotutela, a tutela preventiva e a tutela corretiva, que pode ser geral ou especial na imprensa.

The present study proposes a new vision about the right to identity. Normally, identity was observed only through a static-dynamic dichotomous perspective. The idea is that it starts to be observed through another prism: identity-identification and identity-perception. This is in line with the notion of false light that italian and US law adopt. The first, with a simpler content, is marked by the notions of sameness and ipseity, that is, the possibility that someone is always identified based on certain characteristics, regardless of time and space. Examples of it that are exposed in the work are the name, sexual identity, genetic identity, digital identity, subdivided into profiles and avatars, and national identity. The second, in turn, of more complex content, includes several assumptions. It is a worldview that is built from a dialogic process, marked by a narrative and that is established in a structure that must be ethical in order to be protected. Examples of it are racial, gender, political, religious and intellectual identities. As it is a relatively recent personality right, it must be distinguished from others that are related to it, such as the rights to image, honor and privacy. In addition, its characteristics need to be understood and its forms of protection analyzed, such as self-protection, preventive protection and corrective protection, which can be general or special in the press.
