A relação obrigacional, considerada em sua complexidade, é composta não apenas por deveres de prestar - os deveres principais e secundários -, mas também por deveres de conduta - os deveres laterais e de proteção. Sua dinamicidade, ao seu turno, implica a permanência ou o surgimento desses últimos deveres após a extinção daqueles. Nesta dissertação, são justamente estudados os deveres que hão ser cumpridos pelas partes após a extinção da principal atividade exigida do devedor. A esses deveres dá-se o nome de deveres pós-contratuais e o seu adimplemento é necessário para que possam ser integralmente satisfeitos os interesses do credor na relação contratual. Para que fosse possível delinear um panorama geral dos deveres pós-contratuais, dedicamo-nos, inicialmente, a conceitua-los e, nesse caminho, analisamos os seus fundamentos (determinações contratuais ou legais expressas, assim como a integração proporcionada pela aplicação do princípio da boa-fé objetiva), bem como as suas funções (manutenção da finalidade alcançada pelo credor com a relação contratual e proteção das partes - e de terceiros relacionados a elas ou ao objeto contratual - física, moral e patrimonialmente de interferências danosas da contraparte). Alcançado o conceito de deveres pós-contratuais, passamos à construção de sua tipologia, como medida necessária especialmente para a concretização dos deveres impostos pelo princípio da boa-fé objetiva. Também foi objeto de especial estudo o descumprimento dos deveres pós-contratuais. Nesse âmbito, foi definido o regime da responsabilidade aplicável à sua violação, e foram examinadas as formas e as consequências de seu inadimplemento.

The obligational relationship, if considered in its full complexity, is composed not only of the duties of performance - the main and secondary duties - but is also composed of duties of conduct - the ancillary and protection duties. The dynamic character of the obligational relationship implies that the ancillary and the protection duties may persist or even arise after the duties of performance are satisfied. In this dissertation, we analyze the duties that must be fulfilled under a contract after the main performances have been delivered by the debtor. Such duties are named post-contractual duties, and their performance is required in order to give full satisfaction to the creditor's interest in the contract. In order to delineate a general outlook of the post-contractual duties, we dedicated ourselves to provide a definition and to analyze their basis (contractual or statutory provisions or even the effect of the normative integration operated by the principle of objective good faith), as well as their functions (preservation of the objective pursued under the contract and protection of the contracting parties - and third parties who are related to the latter or with the object of the agreement - against detrimental interference in a physical, moral and patrimonial level). Once the post-contractual duties were defined, we have studied their categories, as a necessary step in order to provide a concrete meaning to the duties imposed by the principle of objective good faith. This dissertation also studies the breach of the postcontractual duties. In this regard, the dissertation explores the liability regime applicable to their breach and the species and consequences of the failure to comply with such post-contractual duties.
