A presente dissertação tem por objetivo o estudo da Teoria das Exceções, categoria eficacial que integra o conteúdo de determinadas relações jurídicas. A pesquisa, que constitui trabalho de direito brasileiro, utilizou o método dedutivo e examinou: a) o papel atribúido às exceções no contexto do direito de defesa; b) o nascimento e a evolução da categoria no direito romano; c) as premissas para a delimitação técnico-jurídica do conceito de exceção; d) as suas várias espécies; e e) a distinção da exceção de outras figuras afins. O estudo demonstrou o pertencimento das exceções ao Direito Privado Material, a sua imprescritibilidade, a natureza jurídica de poder em sentido estrito da referida categoria eficacial, posição jurídica subjetiva ativa elementar derivada de normas secundárias ou de competência, concluindo pela manutenção da utilidade técnica e científica do conceito de exceção.

This dissertation studies the Theory of Exceptions, an efficacy category that belongs to certain legal relations. The research, circumscribed to Brazilian Legal System, by means of a deductive method has examined: a) the role of exceptions in the context of the right to defense; d) the rise and evolution of the category in Roman Law; c) the requirements to the technical-legal circumscription of the concept "exception"; d) its several species; and e) the distinction between exception and other related concepts. The study demonstrates the suitability of exception in Material Private Law, its imprescriptibility, the legal nature of the power of the efficacy category, its elementary active subjective legal position derived of secondary or competence norms; concluding with a defense of the technical and scientific utility of the concept "exception".
