O Código Civil de 2002 inseriu, no Direito de Família, a cláusula geral da plena comunhão de vida, conforme prevê o art. 1511. Trata-se de uma cláusula geral de comportamento conjugal, de conteúdo ético não totalmente definido, ao dispor que o casamento estabelece comunhão plena de vida, com base na igualdade de direitos e deveres dos cônjuges. O presente trabalho analisa o dever de o Estado atender aos ditames constitucionais de proteção da família e de igualdade de gêneros, bem como examina a atuação do Poder Judiciário na busca de igualdade material, quando da fragmentação da família. Aborda aspectos históricos, sociológicos, antropológicos, psicológicos, econômicos e laborais da sociedade contemporânea. O exame de ordenamentos jurídicos estrangeiros sugere o aprimoramento do instituto dos alimentos e dos alimentos compensatórios, a introdução de nova forma de divisão de bens por ocasião do divórcio que pode ou não levar em conta as ocorrências durante a vida conjugal como ocorre no Direito de Família nos Estados Unidos e, do Direito de Família Alemão, esse exame introduz figura semelhante ao instituto da Versorgungsausgleich, que traz segurança ao cônjuge não ativo ou parcialmente ativo profissionalmente prejudicado na atividade aquisitiva por motivo de dedicação à administração do lar e à educação dos filhos, em estreita cooperação com as entidades de Direito Previdenciário.

The Civil Code of 2002 inserted the general clause of full communion of life to Family Law, as provided in art. 1511. It is a general clause of conjugal behavior, with ethical content not fully defined, providing that marriage establishes full communion of life, based on the equal rights and duties of the spouses. The present study analyzes the duty of the State to comply with the constitutional rights of family protection and gender equality, as well as examining the Judiciary's action in the search for material equality, at the dissolution of the family. It addresses historical, sociological, anthropological, psychological, economic and labor aspects of contemporary society. The examination of foreign legal systems suggests the improvement of alimony and and compensatory alimony, the introduction of a new form of division of property on the occasion of divorce that may or may not take into account occurrences during the married life as it occurs in Family Law in the United States and, from the German Family Law, introduce a similar figure to the Versorgungsausgleich, which brings safety to the non-active or partially active spouse who has been professionally disadvantaged in the acquisition activity due to the administration of the home and the education of the children in close cooperation with Social Security Law entities.
