O estudo da história da organização judiciária no Brasil sempre esteve prioritariamente focado no aspecto estrutural, sem grande preocupação com os sistemas de recrutamento dos magistrados, os requisitos para o ingresso na magistratura e as condições de permanência e garantias de exercício, elementos que, conforme diferentes correntes doutrinárias, podem ser tomados como indicadores da qualidade da prestação jurisdicional. A abordagem das figuras pré-republicanas brasileiras, organizada a partir de seus três grandes períodos históricos (Brasil-Colônia; Reino Unido do Brasil, Portugal e Algarves; e Império do Brasil) e centrada nessa perspectiva, possibilita uma análise mais acurada da consolidação e da evolução da carreira da magistratura no Brasil. Além disso, é possível, a partir do exame desses mesmos elementos, colher subsídios históricos bastante relevantes para as discussões republicanas subsequentes acerca da obrigatoriedade da conciliação; das limitações de alçada e de acesso à jurisdição; da unicidade da carreira da magistratura; da especialização dos órgãos jurisdicionais; e da existência de mandatos ou períodos pré-determinados de exercício.

The study of the history of the court organisation in Brazil has always been primarily focused on the organizational structure rather than on the recruitment system for judges, the requirements to serve the bench, the conditions to hold the position, or the safeguards to be on the bench. According to different doctrines, these elements can be used to access the quality of the judiciary. The approach of the pre-republican figures in Brazil, based on its three important historical periods (Colonial Brazil; the United Kingdom of Portugal, Brazil and the Algarves; and the Empire of Brazil) and focused on this perspective, allows a detailed analysis of the judicial career progression and development in Brazil. Moreover, by analyzing these same elements, relevant historical data can be collected for further republican discussions about the obligation of settlement conferences; limited jurisdiction and proper access to justice; the uniqueness of a judicial career; the specialization of the judicial authority; and a term of office or fixed periods in office.
