O presente trabalho propõe-se a analisar as mudanças promovidas pelo Estatuto da Pessoa com Deficiência no Código Civil Brasileiro, que levaram à criação da tomada de decisão apoiada como instituto protetivo das pessoas com deficiência, tratando-a como modelo sui generis. Pretendeu-se realizar o aprofundamento do conteúdo abordado na Convenção Internacional sobre os Direitos das Pessoas com Deficiência, bem como no Estatuto da Pessoa com Deficiência e a observância dos novos paradigmas legais e jurisprudenciais sobre o assunto. Foram trabalhados os conceitos de dignidade da pessoa humana, deficiência, capacidade civil, curatela e tomada de decisão apoiada, foco principal da pesquisa, tecendo-se considerações, ainda que breves, sobre a aplicabilidade dos tratados de direitos humanos e o Comentário Geral no 1, produzido pelo Comitê sobre os Direitos das Pessoas com Deficiência, sendo certo que sua importância consiste na atualidade, interdisciplinaridade e relevância do tema, em prol da efetivação de direitos assumidos perante a comunidade internacional, relacionados à inclusão social e à promoção da dignidade da pessoa humana.

This paper aims to analyze the changes promoted by the Statute of the Person with Disabilities in the Brazilian Civil Code, which led to the creation of supported decision-making as a protective institute for persons with disabilities, treating it as a sui generis model. The study intended to deepen the content addressed in the International Convention on the Rights of Persons with Disabilities, as well as the Statute of the Person with Disabilities and the observance of new legal and jurisprudential paradigms on the subject. The concepts of human dignity, disability, civil capacity, guardianship and supported decision making, the main focus of the research, were elaborated, and brief considerations were made about the applicability of human rights treaties and General Comment No 1, produced by the Committee on the Rights of Persons with Disabilities. Its importance consists in the timeliness, interdisciplinarity and relevance of the theme, in order to fulfill the rights assumed before the international community, related to social inclusion and the promotion of dignity of the human person.
