O presente trabalho tem por objetivo investigar, sob a ótica do Direito Civil, os limites da liberdade de disposição em matéria matrimonial, com especial enfoque no dever de fidelidade. A partir do estudo do conceito e da natureza do casamento, busca-se analisar os fundamentos jurídicos e antropológicos do dever de fidelidade, crescentemente atacado em diferentes países, bem como sua conexão com o princípio da monogamia. Ademais, com base na verificação da dinâmica legal e jurisprudencial dos pactos antenupciais no Brasil e nos Estados Unidos, analisa-se o confronto entre a autonomia da vontade e a ordem pública nos dois ordenamentos. Por fim, é realizado exame histórico-jurídico sobre a dicotomia entre direito público e privado e entre moral e amoralidade acerca do casamento.

The present work aims to investigate, from the perspective of Private Law, the limits of freedom of disposition in matrimonial matters, with special focus on the duty of fidelity. From the study of the concept and nature of marriage, we seek to analyze the legal and anthropological foundations of the duty of fidelity, increasingly attacked in different countries, as well as its connection with the principle of monogamy. Furthermore, based on the verification of the legal and jurisprudential dynamics of prenuptial agreements in Brazil and in the United States, the confrontation between private autonomy and public order in both countries is analyzed. Finally, a historical-legal examination is carried out on the dichotomy between public and private law and between morality and amorality regarding marriage.
