Cuida-se de investigação na jurisprudência do Superior Tribunal de Justiça sobre os critérios para conversão da prestação específica em perdas e danos, a fim de verificar se há um conflito entre o disposto no Código Civil e no Código de Processo Civil sobre o tema. O primeiro capítulo é voltado para a exposição do inadimplemento da obrigação contratual e dos critérios para seu reconhecimento. O segundo capítulo apresenta uma análise quantitativa e qualitativa da jurisprudência do Superior Tribunal de Justiça, alcançada após pesquisa com os metadados: inadimplemento obrigação$ e contrato$ por meio da ferramenta de busca disponível no site do tribunal. Foram selecionados acórdãos julgados entre 01/01/1990 a 21/12/2022, pela Terceira e Quarta Turmas, pela Segunda Seção e pela Corte Especial.

It deals with research in the jurisprudence of the Superior Court of Justice on the criteria for converting the specific benefit into damages, in order to verify if there is a conflict between the provisions of the Civil Code and the Code of Civil Procedure on the subject. The first chapter is focused on exposing the default of the contractual obligation and the criteria for its recognition. The second chapter presents a quantitative and qualitative analysis of the jurisprudence of the Superior Court of Justice, achieved after research with the metadata: default obligation$ and contract$ through the search tool available on the court's website. Judgments judged between 01/01/1990 to 12/21/2022, by the Third and Fourth Panels, by the Second Section and by the Special Court were selected.
