O sistema público de saúde vem sofrendo com a crescente e onerosa judicialiação por parte de seus beneficiários, e muitas vezes os gestores nem possuem estratégias que possam enfrentar essa judicialização. O objetivo central da pesquisa é descrever o fenômeno de judicialização da saúde no município de Ribeirão Preto -SP, identificar as estratégias de enfrentamento adotadas pelos gestores e conhecer as decisões judiciais. O estudo pretendeu descrever o perfil das ações ajuizadas, a sua causa de pedir, o número de processos protocoladas e os respectivos autores, além de descrever os atos do Poder Público destinados a enfrentar a judicialização e os resultados diante das decisões judiciais. Trata-se de um estudo descritivo, que utilizou entrevista semiestruturada junto aos atores institucionais da judicialização (ativo e passivo), levantamento de dados sobre demandas judiciais e administrativas de bens relacionados ao direito à saúde. O estudo identificou que o município de Ribeirão Preto possui como estratégia compartilhada entre os atores da judicialização, a Comissão de Análise de Solicitações Especiais (CASE), que muito se assemelha as estratégias de Núcleo de Apoio Técnico (NAT). Os resultados demonstraram que o órgão técnico emite parecer sempre dentro dos processos judiciais para auxiliar os magistrados em suas decisões e que parte dos atores da judicialização não conhecem a referida estratégia e seus procedimentos, resultando em ações judiciais de medicamentos que podiam ser adquiridos pela via administrativa. Ademais, a maioria das decisões judiciais foram contrárias as orientações técnicas emitidas pela Comissão. Nesse sentido, o estudo conclui que a estratégia utilizada pelo o município de Ribeirão Preto não contribuiu para diminuição da judicialização da saúde. Depreendeu-se que a solução consensual deve ser estimulada, como estratégia de prevenção da judicialização da saúde, relevando os canais de comunicação entre os atores institucionais da saúde e do judiciário; a criação ou adoção de câmaras de mediação e conciliação tem grande adequação por ser extrajudicial, de baixo custo, célere e visar à pacificação dos conflitos, diminuindo as demandas dos tribunais, principalmente no que tange uma área técnica distante do expertise dos magistrados: a saúde.

The public health system has been suffering from the growing and costly judicialization by its beneficiaries, and often managers do not even have strategies that can face this judicialization. The main objective of the research is to describe the phenomenon of health judicialization in the city of Ribeirão Preto - SP, identify the coping strategies adopted by managers and know the judicial decisions. The study aimed to describe the profile of the lawsuits filed, their cause of asking, the number of cases filed and the respective authors, in addition to describing the acts of the Public Power intended to face judicialization and the results before judicial decisions. This is a descriptive study, which used semi-structured interviews with the institutional actors of judicialization (active and passive), data collection on judicial and administrative claims of assets related to the right to health. The study identified that the municipality of Ribeirão Preto has as a shared strategy among the actors of judicialization, the Commission for The Analysis of Special Requests (CASE), which closely resembles the strategies of the Technical Support Center (NAT). Which closely resembles the Strategies of Technical Support Center (NAT). The results showed that the technical body always issues an opinion within the judicial processes to assist the magistrates in their decisions and that part of the judicialization actors do not know the said strategy and its procedures, resulting in lawsuits of medicines that could acquire through the administrative means. Moreover, most judicial decisions were contrary to the technical guidelines issued by the Commission. In this sense, the study concludes that the strategy used by the municipality of Ribeirão Preto did not contribute to the reduction of health judicialization. It was insgiven that the consensual solution should be stimulated, as a strategy to prevent the judicialization of health, raising the channels of communication between the institutional actors of health and the judiciary; the creation or adoption of mediation and conciliation chambers has great adequacy because it is extrajudicial, low cost, swift and aimed at the pacification of conflicts, reducing the demands of the courts, especially with regard to a technical area far from the expertise of magistrates: health.
