A judicialização da saúde é a construção de um direito da sociedade, mas deve ser justa e consciente, uma vez que os autores não serão impedidos de pleitear judicialmente o que acreditam ser de direito, tampouco serão esgotadas as vias processuais como instrumento para o alcance do direito pretendido. A lacuna e omissão dos poderes legislativo e executivo em relação a saúde, obrigatoriamente forçam o poder judiciário a se posicionarem sobre o assunto e a decidir sobre medidas sanitárias. A proposta desse trabalho é a criação e desenvolvimento de um sistema de controle e fiscalização dos insumos concedidos pelas vias judiciais.
