Esta dissertação tem como objetivo investigar de que modo o Projeto de Intervenção Urbana (PIU), instrumento criado no Plano Diretor Estratégico de São Paulo em 2014, altera a participação de atores não-estatais na concepção, debate público e elaboração de políticas de reestruturação urbana em São Paulo e qual é o papel exercido pelo projeto urbano nesse processo. Organiza breve histórico de políticas de reestruturação urbana paulistanas para identificar permanências e alterações quanto à utilização de projetos urbanos ao longo dos anos e analisar como o PIU se insere nessa trajetória identificada como de proliferação e diversificação de instrumentos para promover a reestruturação urbana. A pesquisa utiliza o estudo de caso do processo de elaboração do PIU Vila Leopoldina - Villa-Lobos (PIU-VL) no Executivo municipal para investigar o tema, com base em dados de pesquisa documental e de arquivo, acompanhamento do processo participativo de elaboração do PIU-VL, entrevistas e pesquisa de campo. As análises realizadas identificam que o legado de políticas anteriores e percepções sobre a ineficiência do Estado na reestruturação urbana influenciaram a criação do PIU, que é caracterizado como instrumento de articulação e coordenação usado para pactuação de alterações regulatórias. O PIU é analisado como instrumento que cria regras para que o setor privado possa acessar o Estado para formular propostas de reestruturação urbana e ao mesmo tempo regula como o poder público deve conduzir ou decidir sobre as transformações pretendidas. Discute-se sobre o PIU como mecanismo que simula por meio de projeto urbano parte das trans- formações urbanas propostas servindo para a negociação de interesses entre Estado, privado e sociedade civil, que assume características que o aproximam de um modelo contratual para reestruturação urbana e que é marcado por aspectos de complexidade, fragmentação e flexibilidade. Debate-se como o PIU impacta na fragmentação territorial e do debate público, com procedimentos participativos e projeto urbano que aumentam a segurança jurídica do processo e como o formato do PIU define e comunica o interesse público da transformação. Investigam-se as formas pelas quais o PIU cria exceções e flexibilidades, como ao postergar acordos ou definições para outros instrumentos, ao indicar a possibilidade de contratação de projetos futuros e ao reduzir o conteúdo a ser pactuado na fase de elaboração do PIU a temas específicos, em processos que buscam lidar com riscos e garantias com objetivos distintos para os envolvidos na proposta do PIU. Entende-se que o PIU influencia a definição e mobilização do interesse público da reestruturação urbana e que este processo tem especificidades no caso de propostas de origem privada.

This dissertation aims to investigate how the Urban Intervention Project (PIU), an instrument created by the City of São Paulo Strategic Master Plan in 2014, changes the participation of non-State actors in the conception, public debate and elaboration of urban restructuring policies in São Paulo and what is the role of the urban project in this process. It organizes a brief history of policies for urban restructuring in São Paulo to identify continuities and changes in the use of urban projects over the years and to analyze the PIU's entrance in this trajectory characterized by the proliferation and diversification of instruments to promote urban restructuring. The research uses the case study of the PIU Vila Leopoldina - Villa-Lobos (PIU-VL) elaboration process to investigate the theme, based on research data from archive and documental research, follow-up of PIU-VL's participatory process, interviews and field research. The analyses show that the legacy of previous policies and perceptions of the State's inefficiency on urban restructuring processes have influenced the creation of the PIU, which is characterized as an instrument of articulation and coordination used for reaching agreements on regulatory changes. The dissertation analyses the PIU as an instrument that creates rules for the private sector to access the State in order to formulate urban restructuring proposalsand simultaneously regulates how the public authority should conduct or decide on the expected transformations. It discusses the PIU as a mechanism that simulates a part of the proposed urban transformation through the use of urban projects in order to negotiate interests between the State,the private sector and civil society, that assumes characteristics that bring it closer to a contractual model for urban restructuring and that is marked by complexity, fragmentation and flexibility aspects. It debates PIU's impacts, such as the territorial and public debate fragmentation, with participatory procedures and urban projects that increase the process'legal security and how the PIU's format defines and communicates the transformation's public interest. It investigates the means by which the PIU creates exceptions and flexibilities, such as postponing deals and definitions for other instruments, indicating the possibility of new contracts for future projects and reducing to specific themes the contents to be agreed during the elaboration phase of the PIU, with processes that seek to deal with different goals about risks and guarantees for those involved in the PIU proposition. It is understood that the PIU influences the definition and mobilization of the public interest in the urban restructuring and that this process has specificities in the case of private initiative proposals.
