A presente tese evidencia no tecido urbano paulistano as relações existentes entre os espaços públicos e privados resultantes da legislação urbanística da cidade, bem como propõe a transformação desta relação por meio da incorporação do projeto aos instrumentos de planejamento. Verifica-se que a regulação da propriedade privada pelo Estado por meio dos instrumentos vigentes não tem sido capaz de cumprir seu papel indutor da produção do que se conceituou por espaço social, ou seja, do espaço de uso coletivo e no qual se dá a vida cotidiana e de que este fato vem levando à criação de espaços progressivamente mais fragmentados e desconexos na cidade de São Paulo. Parte-se da hipótese de que este fenômeno reside em parte no distanciamento entre planejamento intraurbano e desenho urbano e que é possível encontrar maneiras de incorporar o desenho nesta regulação, de modo a orientar a produção do tecido urbano e suas transformações, principalmente no que concerne ao setor privado. Os espaços privados, para cumprirem sua função social de espaços coletivos, podem ser regulados por meio de instrumentos que incorporem o projeto urbano e criem alternativas ao padrão de tecido urbano existente, criando novos padrões a partir da superação dos limites entre público e privado. A tese analisa as relações da propriedade privada e de sua regulação com o espaço público paulistano particularmente em áreas de grande potencial de transformação e estabelece, através dos recursos do projeto, critérios metodológicos que permitem incluir no instrumental público de planejamento, novas maneiras de transformação deste espaço, com o objetivo de produzir um espaço coletivo de melhor qualidade.

The thesis highlights the existing relations between public and private spaces that result from urban regulation at the metropolis of São Paulo, as well as propose new ways of transforming this relations through the inclusion of urban design repertoire in urban planning instruments. The regulation of private property by the State in São Paulo via the current planning instruments has not been capable of ful!lling its role as inductor of the production of "social space", concept used here as the space of collective use and appropriation. This incapacity has led to the creation of fragmented, disconnected spaces in the city. The hypothesis presented is that this phenomenon occurs partially due to the separation between urban planning and urban design and, so, it is possible, through academic research, !nd ways to incorporate design into regulation instruments, in order to reorientate the production of the urban fabric and its transformations. Private spaces, in order to ful!ll their social function of producing collective space, can be regulated through instruments that incorporate urban design and create alternative patterns for the urban fabric, generating new and better ones through the overcoming of limits between public and private. The thesis, in resume, analyses the relations of private property and its regulation with São Paulo's public space, particularly areas with great transformation potential, and establishes methodological criteria for the incorporation in public land regulations of new ways of transforming spaces, aiming to produce a collective space of better quality.
