O objetivo deste trabalho é investigar a existência de viés na solução das disputas comerciais submetidas ao Órgão de Solução de Controvérsias (DSB - Dispute Settlement Body). O DSB é o órgão responsável pela resolução de conflitos dentro da Organização Mundial do Comércio (OMC). O estudo procura verificar se há evidências de relações entre os resultados das controvérsias e variáveis indicativas do poder econômico dos países envolvidos. Inicialmente se apresenta a estrutura processual do DSB. A seguir é realizada uma revisão bibliográfica em que se discutem aspectos da Nova Economia Institucional, levantam-se critérios de avaliação de instituições judiciais e se discute a capacidade de coerção da OMC. A atuação do DSB foi estudada através dos resultados das controvérsias a ele submetidas. Foram realizadas duas análises complementares e distintas: (1) estudos comparativos de casos e (2) análises quantitativas em que foram contrastadas médias de grupos. O objetivo dos estudos comparativos de casos foi apresentar características recorrentes das controvérsias. A pesquisa quantitativa utilizou análise estatística descritiva e análise inferencial. Nas análises estatísticas foram verificadas a duração dos Paneis e apelações, seus resultados e a implementação das suas decisões. As conclusões sugerem a existência de limitações na implementação das recomendações do DSB. Adicionalmente, indicam uma concentração de casos envolvendo os países mais poderosos.

This work intends to check if there is any obliquity in the solution of commercial disputes by the Dispute Settlement Body - DSB. The DSB is responsible for the solution of conflicts in the World Trade Organization. The study looks for evidences of relationships between the controversies results and variables that indicate the economic power of the countries that take part on them. The work first presents the processual structure ofthe DSB. Then it s done a bibliographical revision where some aspects of the New Institutional Economics are discussed. Finally, the work presents criterion for evaluation of judicial institutions and discusses the enforcement capability of the WTO. The work of the DSB was studied through the results of its controversies. Two distinct and complementary analyses were done: (1) case comparative studies and (2) quantitative studies were groups averages were contrasted. The target of the comparative studies was to present recurring characteristics of the controversies. The quantitative research used descriptive statistical analysis and inferential analysis. The statistical analysis checked the length of the Panels and appeals, its results and the implementation of its recommendations. The conclusions suggest the presence of limits to implement the recommendations of the DSB. Additionally indicate a concentration of cases between the powerful countries.
