Este estudo se insere na área das Organizações Sociais, entidades criadas a partir do Plano Diretor da Reforma do Aparelho Administrativo do Estado Brasileiro, proposto pelo Poder Executivo em 1995. Essas entidades, privadas e sem fins lucrativos, fazem parte do chamado Terceiro Setor, com propósitos claramente definidos de absorver atividades não-exclusivas do Estado, mediante qualificação específica. O trabalho busca, preliminarmente, definir o perfil das entidades sem fins lucrativos no Brasil (sentido lato), características peculiares, legislações pertinentes e formas de constituição e manutenção do património social. Analisa, no âmbito da Reforma do Estado, o marco legal das Organizações Sociais e o contrato de gestão como principal instrumento regulador das ações dessas organizações. Nesse particular, investiga os modelos de avaliação de desempenhos constantes dos contratos já em vigor, questionando se os respectivos indicadores são eficazes para avaliar o desempenho institucional. A partir dessa análise, propõe um modelo de avaliação de desempenho com base no resultado económico produzido pelas atividades executadas por essas organizações. Neste estudo, privilegiam-se as Organizações Sociais de assistência social, cujos recursos são oriundos exclusivamente de doações e subvenções governamentais e não governamentais. Espera-se, pois, que o presente estudo contribua para a definição de bases eficazes para a aplicação do contrato de gestão nessas organizações.

This study pertains to the area of Social Organizations, entities created from the Director Plan for the Reform of the Administrative System of the Brazilian State, proposed in the year of 1995 by Executive Power. These private and not for profit entities, are part of the so called 'Third Sector', with purposes clearly defined, to absorb activities not exclusive to the State, by a process of meeting specific qualification requirements. This work, seeks primarily to define, (in a broad sense) the profile of not for profit Entities in the State, including peculiar characteristics such as: pertinent legislation, forms of constitution and the maintenance of social assets. It analyses, at the levei of State Reform, the legality of the Social Organizations and the Management Contract as the principal regulatory instrument regarding the actions of not for profit Organizations. On this matter, it researches the pattern of performance assessment relating to contracts in effect. It asks questions about the efficiency of the respective indicators to evaluate the performance of the organizations. Starting from this analyses, it proposes an evaluation pattern of fulfillment based on economic results produced by the activities of these organizations. This research will benefit the social entities that provide social assistance, whose resources consist of subsidies and donations by the government and the private sector as well. It is hoped then, that this study will contribute to the definition of efficient bases for the application of management contracts in these organizations.
