O processo de globalização da economia e as operações de fusões e aquisições de empresas cada vez mais frequentes intensificaram o nível de transações internacionais entre partes relacionadas, que respondem atualmente por cerca de 60% do comércio internacional. Por outro lado, a formação dos blocos econômicos de livre comércio reduziu as receitas provenientes dos tributos alfandegários, despertando crescente interesse das autoridades fiscais em tributarem adequadamente estas transações no âmbito do Imposto de Renda. A combinação destes dois fatores explica a crescente importância do preço de transferência no contexto mundial. Neste cenário, a presente dissertação compara, na ótica contábil-tributária, a sistemática brasileira sobre preços de transferência com as Diretrizes da OECD e com as regras americanas. Neste sentido, a partir de uma síntese da evolução das diversas abordagens acadêmicas sobre o assunto, visando situá-lo no contexto do problema do preço de transferência, segue-se um retrospecto do tratamento tributário adotado pelos EUA e das orientações da OECD, de forma a permitir uma comparação com a postura adotada pelo Fisco brasileiro. A legislação brasileira é descrita e comparada com as Diretrizes da OECD e com as regras americanas, apontando-se as principais diferenças entre elas, com a inclusão de proposta de alterações a serem introduzidas na sistemática brasileira de forma a adequá-la aos parâmetros internacionalmente aceitos. Procede-se, também, a uma síntese das tendências do tratamento a ser dispensado pelo Fisco brasileiro na tributação das transações internacionais entre partes relacionadas

The process of economic globalization and the increasing frequency of mergers and acquisitions has increased the levei of cross-border trading between related parties, which today represents about 60% of International trade. On the other hand, the emergence of free trade areas has eroded customs duty revenues, leading to the increasing interest of tax authorities in properly assessing these transactions in terms of income tax. These issues together explain the growing importance of transfer pricing in the world context. Taking the above scenario into account, this dissertation compares the Brazilian transfer pricing system to the OECD Guidelines and the American rules, at the levei of tax and accounting. Thus, after a summary of the evolution of the different academic approaches to this issue, to facilitate a comprehensive understanding of the subject, there is a retrospective look at the American rules and the OECD Guidelines on transfer pricing to permit their comparison to the Brazilian system. The Brazilian legislation is described and contrasted with the OECD Guidelines and the American rules, pointing out their principal differences, including a proposal of alterations to be made in the Brazilian system in order to align it with the International pattems on this subject. In addition, there is a summary of Brazilian trends in taxation of cross-border related parties transactions
