O trabalho buscou minimizar as críticas ao controle de constitucionalidade, especialmente aos litígios estruturais, apresentando um trajeto alternativo e intermediário através da democracia deliberativa, sobretudo para conceder maior legitimidade democrática e eficiência. Apesar de não conseguir apresentar novos instrumentos procedimentais e processuais atípicos, conseguiu encontrar quatro elementos deontológicos a serem observados quando da confecção dessas novas diretrizes processuais: elemento deontológico da comunicação social, elemento deontológico da deliberação interna, elemento deontológico do diálogo institucional e elemento deontológico da continuidade.

The research sought to minimize as critical to the judicial review, especially to structural litigation, presenting an alternative trajectory and through deliberative democracy above all to democratic legitimacy and effective legality. Despite not being able to present new atypical procedural instruments, it managed to find four deontological elements to be observed when preparing these new procedural guidelines: deontological element of social communication, deontological element of internal deliberation, deontological element of institutional dialogue and deontological element of continuity.
