A pesquisa se insere nos temas da história da imigração italiana no Brasil e da história do direito do trabalho brasileiro, e buscou responder como os movimentos sociais dos imigrantes italianos no Brasil, dos primeiros anos da República, nortearam a origem dos direitos do trabalho brasileiro, e de que modo esses movimentos foram igualmente influenciados pela legislação trabalhista e migratória brasileiras. Com o objetivo de identificar a influência dos movimentos sociais daqueles imigrantes, dos primeiros 20 anos do século XX, na legislação trabalhista brasileira, e verificar quais foram os efeitos dessas influências, a hipótese inicial suscitada considerava que os italianos imigrados teriam sido responsáveis por vários movimentos sociais e vasta legislação trabalhista favorável aos trabalhadores. A investigação foi feita mediante análise materialista histórica do direito, partindo dos movimentos históricos estudados para alcançar a legislação editada. Pelo estudo interdisciplinar em direito e história fez-se a revisão bibliográfica dessas duas áreas, apoiada na pesquisa empírica de análise em fontes primárias do período estudado (legislação, documentos históricos, registros de jornais e revistas e discursos parlamentares), e em dados demográficos de imigração italiana no Brasil. Pesquisou-se movimentos associativos italianos da metade do século XIX até o primeiro vintênio do século XX e legislações trabalhistas e migratórias editadas naqueles 20 primeiros anos. Como principais resultados a pesquisa identificou a existência de movimentos associativos de italianos desde a metade do século XIX até o decorrer do século XX no Brasil, bem como de greves influenciadas por imigrantes italianos no século XX. Fruto dos movimentos estudados, igualmente confirmou a influência italiana na edição e discussão de legislação trabalhista e migratória nos anos de 1907, 1913, 1917, 1919 e 1921. Negando parcialmente a hipótese de pesquisa, o trabalho verificou que a contribuição italiana na formação da classe operária brasileira teve maior relevância para a conscientização de classe do que na produção de legislações trabalhistas que favorecessem os trabalhadores.

The research is part of the themes of the history of Italian immigration in Brazil and the history of Brazilian labor law, and tried to answer how the social movements of Italian immigrants in Brazil, in the early years of the Republic, guided the origin of Brazilian labor rights, and how these movements were equally influenced by Brazilian labor and immigration legislation. Aiming to identify the influence of the social movements of those immigrants, from the first 20 years of the 20th century, in the Brazilian labor legislation, and to verify what were the effects of these influences, the initial hypothesis raised considered that the Italian immigrants would have been responsible for several social movements and extensive labor legislation favorable to workers. The investigation was carried out through a historical materialist analysis of the law, starting from the historical movements studied to reach the enacted legislation. Through the interdisciplinary study in law and history, a bibliographical review was carried out in these two areas, supported by empirical research of analysis in primary sources of the studied period (legislation, historical documents, newspaper and magazine records and parliamentary speeches), and in demographic data of Italian immigration in Brazil. Italian associative movements from the mid-19th century to the first twenty years of the 20th century and labor and migration legislation enacted in those first 20 years were researched. As main results, the research identified the existence of associative movements of Italians from the mid-19th century to the course of the 20th century in Brazil, as well as strikes influenced by Italian immigrants in the 20th century. As a result of the studied movements, it also confirmed the Italian influence in the edition and discussion of labor and immigration legislation in the years 1907, 1913, 1917, 1919 and 1921. Partially denying the research hypothesis, the work verified that the Italian contribution in the formation of the Brazilian working class had greater relevance for class awareness than in the production of labor laws that favored workers.
