O presente trabalho tem como problema de pesquisa o seguinte questionamento: quais têm sido os efeitos da judicialização da educação infantil em creche no Município de Ribeirão Preto? Este problema de pesquisa foi elaborado a partir de um estudo exploratório inicial que identificou que a judicialização da educação infantil e o problema das filas de espera por vagas em creche no município eram uma constante e assumiam contraditórias formatações e complexas relações ao longo do tempo. Tendo este questionamento e o contexto que o subjaz como referenciais iniciais de delimitação do tema, estabelece-se como objetivo geral: analisar os efeitos da judicialização da educação infantil em creche a partir do contexto do Município de Ribeirão Preto. Quanto aos objetivos específicos que aparelham a consecução do geral, temse: a) efetuar uma revisão bibliográfica para a abordagem dos principais temas relacionados ao problema de pesquisa não apenas no campo das produções em direito, mas também em alguns campos que tenham uma interface significativa com a análise proposta; e b) identificar, sistematizar e analisar os documentos que compõem o campo empírico e que guardam pertinência com o problema de pesquisa, bem como conectar este último campo com a revisão de literatura a partir da construção de categorias exploratórias e de análise. Para o desenvolvimento dos objetivos que foram traçados, trata-se, metodologicamente, de uma pesquisa empírica qualitativa e quantitativa com utilização das técnicas da análise de conteúdo para a descrição, inferência e interpretação dos documentos selecionados, sendo eles reputados, majoritariamente, aos órgãos do sistema de justiça e à Prefeitura Municipal de Ribeirão Preto. Em termos de marco teórico-analítico, a pesquisa é desenvolvida sob uma perspectiva crítica do direito construída a partir de frentes teóricas articuladas, respectivamente, nos três capítulos iniciais, os quais abrangem: um marco histórico-legal a partir, sobretudo, dos estudos do campo educacional; o desvelamento do direito à creche por meio da articulação de desigualdades que marcam seu acesso dentro perspectiva crítico-feminista e interseccional ao direito; e, por fim, a análise da judicialização dentro desses pressupostos mencionados e com a conexão de perspectivas do campo do direito, da educação e das políticas públicas. As conclusões do trabalho consistem na identificação exploratória de efeitos da judicialização da educação infantil no Município de Ribeirão Preto, bem como seus contextos.

The present work has the following research problem: what have been the effects of the judicialization of early childhood education in kindergarten in the city of Ribeirão Preto? This research problem was elaborated from an initial exploratory study that identified that the judicialization of early childhood education and the problem of queues for childcare vacancies in the municipality were a constant and assumed contradictory formats and complex relationships over time. Having this questioning and the context that underlies it as initial benchmarks for delimiting the theme, the general objective was to analyze the effects of the judicialization of early childhood education in day care centers from the context of the Municipality of Ribeirão Preto. As to the specific objectives that make up the general achievement, we have: a) to perform a bibliographic review to address the main issues related to the research problem, not only in the field of productions in law, but also in some fields that have a significant interface with the proposed analysis; and b) to identify, systematize and analyze the documents that make up the empirical field and that retain relevance to the problem exposed, as well as connect the latter field with the literature review from the construction of exploratory categories and analysis. For the development of the objectives that were outlined, it is methodologically a qualitative and quantitative empirical research using the techniques of content analysis for the description, inference and interpretation of the selected documents, which are mainly reputed to the organs of the justice system and the public administration of Ribeirão Preto. In terms of theoretical and analytical framework, the research is developed under a critical perspective of law constructed from theoretical perspectives articulated, respectively, in the three initial chapters, which include: a legal-historical framework based, above all, on studies in the educational field; the unveiling of the right to daycare through the articulation of inequalities that mark its access within a critical-feminist and intersectional perspective to law; and, finally, the analysis of judicialization within these mentioned presuppositions and with the connection of perspectives in the field of law, education and public policies. The conclusions of the work consist in the exploratory identification of the effects of the judicialization of early childhood education in the municipality of Ribeirão Preto, as well as its contexts.
