A Política Nacional de Resíduos Sólidos (PNRS) introduziu a responsabilidade compartilhada pós-consumo do ciclo de vida dos produtos e instituiu a logística reversa obrigatória para produtos e embalagens considerados perigosos à saúde e ao meio ambiente. Propõe a análise do acordo setorial de implementação da logística reversa de produtos eletroeletrônicos de uso doméstico e seus componentes. Objetiva-se a identificação das responsabilidades civis, penais e administrativas dos partícipes (consumidor, Poder Público e setor empresarial) constantes no acordo setorial. Como parte do método, expõe o contexto da PNRS no desenvolvimento sustentável e analisa a natureza jurídica do acordo setorial, definido pela PNRS como de natureza contratual. Constatou-se que os partícipes são responsáveis por obrigações legais e também decorrentes do acordo setorial. Concluiu-se que os consumidores, Poder Público e o setor empresarial (fabricante, importador, distribuidor e comerciante) possuem responsabilidades de natureza civil, penal e administrativa decorrentes do acordo setorial em conjunto com as obrigações de ordem legal.

The National Solid Waste Policy (NSWP) introduced post-consumption shared responsibility for the life cycle of products and instituted mandatory reverse logistics for products and packaging considered dangerous to health and the environment. It proposes the analysis of the sectorial agreement for the implementation of reverse logistics for home electronic products and their components. The objective is to identify the civil, criminal and administrative responsabilities of the participants (consumers, public authorities and business sector) of the sectorial agreement. As part of the method, it exposes the context of the NSWP in sustainable development and analyzes the legal regime of the sectorial agreement, defined by the NSWP as contractual. Has been verified that the participants are responsible for legal obligations and also for the sectorial agreement. It was concluded that consumers, government and the business sector (manufacturer, importer, distributor and trader) have civil, criminal and administrative responsibilities from the sectorial agreement and also from the legal obligations.
