Partindo da tipologia das partes processuais elaboradas por Galanter em 1974, a presente pesquisa analisa as diferentes experiências entre os jogadores repetitivos e os participantes eventuais no Incidente de Resolução de Demandas Repetitivas. Essa técnica de julgamento, inserida no ordenamento jurídico brasileiro pelo Código de Processo Civil de 2015, vincula, obrigatoriamente, o entendimento de todos os juízos submetidos à área de competência do tribunal que proferiu a decisão de mérito, o que potencializa as chances de os jogadores repetitivos expandirem suas vantagens estratégicas a todos os demais casos. A hipótese central que guiou a elaboração do trabalho era, portanto, a de que os jogadores repetitivos pudessem utilizar de maneira estratégica esse novo instrumento processual na fixação de teses jurídicas favoráveis aos seus interesses. Para proceder a essa verificação, buscou-se a analisar o comportamento processual desses atores a partir de alguns indicadores, que foram aplicados em todos os acórdãos de admissibilidade e de mérito publicados pelo Tribunal de Justiça do Estado de São Paulo até 15/06/2018, e que tentaram mapear quem ocupa os polos do conflito que deu ensejo à instauração desse procedimento, quem é o ator responsável por suscitar a sua instauração e como o Tribunal tem lidado com esses pedidos. Também foram escolhidos três casos concretos para aplicação de alguns indicadores de análise do comportamento processual, tais como utilização de sustentação oral, participação de outros interessados, solicitação de diligencias e audiências públicas, entre outros.

Inspired by the typology of parties developed by Galanter, this paper analyses the different experiences between the repetitive players and the "one shooters" during the course of the "Incidente de Resolução de Demandas Repetitivas". This procedural mechanism provided by the Civil Code of 2015 obligatorily binds the understanding of all judgments submitted to the competence of the Court that issued the merit's decision, which increases the chances of the repetitive-players to expand their strategic advantages to all other cases. The central hypothesis that guided this research was, therefore, that the repetitive-players could strategically use this new procedural instrument in the establishment of legal thesis favorable to their interests. To proceed to this verification, we sought to analyze the behavior of these actors through some procedural indicators applied in all judgments of admissibility and merit published by the Court of Justice of the State of São Paulo until 15/06/2018. We tried to map out the disputes in witch the Court applied this technique, who was the actor responsible for giving rise to it, and how the Court of Justice dealt with these requests. We also applied some indicators, such as the use of oral argument, participation of other interested parties, solicitation of due diligence and public hearings, among others, in three particular cases in order to assay the repetitive demand resolution model provided by the Civil Procedure Rules of 2015.
