Nesta dissertação, procurou-se estabelecer uma análise crítica das bases do discurso da doutrina processual clássica acerca das transformações legislativas que promoveram a ampliação dos poderes do relator nos processos judiciais. No bojo dessa discussão, cuja tônica era pensar soluções para a redução do volume de processos nos tribunais, despontam dois importantes temas - o acesso à justiça e a colegialidade -, aos quais se pretendeu dar compreensão mais ampla e mais profunda a partir de outras linhas de pesquisa e literatura. O acesso à justiça foi tomado como perspectiva metodológica, possibilitando criticar as justificativas simplificadoras que são levantadas nesse debate que circundou as reformas processuais que promoveram essa transformação dos poderes do relator, na medida em que revela falhas e vieses nas propostas adotadas. A colegialidade, por sua vez, foi compreendida como uma qualidade institucional dos tribunais, que agrega vantagens e efeitos positivos ao funcionamento dos tribunais e ao processo coletivo de tomada de decisão, e que, por esse motivo, não pode ser compreendida de forma tão simplista como parecem fazer os processualistas. Ademais, partindo-se da premissa de que as regras e procedimentos formais são insuficientes para explicar funcionamento dos tribunais, construiu-se um retrato do Supremo Tribunal Federal e da atuação de seus ministros na função de relatores, por meio da conjugação de relatórios e análises qualitativas e quantitativas, e sob um viés institucional, o qual revela um aumento dos poderes do relator acompanhado de um comportamento individual que explora esses poderes para produzir diretamente efeitos sobre o processo político e sobre o status quo, além de outros problemas que contrastam com as premissas e pretensões do discursos que sustentaram as reformas processuais. Ao fim, conjugando-se todas essas perspectivas e elementos, estabeleceu-se uma análise crítica dessas reformas processuais gerenciais e, especialmente, da ampliação dos poderes do relator, bem como verificaram-se, a partir dessa nova perspectiva, a efetividade dessas alterações legislativas e algumas suas implicações.

In this dissertation, we tried to establish a critical analysis of the bases of the classic procedural doctrine's discourse about the legislative transformations that promoted the extension of the rapporteur's powers in the judicial processes. In the midst of this discussion, whose focus was to think about solutions to reduce the high volume of cases in courts, two important themes emerged - access to justice and collegiality -, to which we sought to give broader and deeper understanding from other lines of research and literature. Access to justice has been taken as a methodological perspective, making it possible to criticize the simplifying justifications that are raised in this debate surrounding the procedural reforms that promoted this transformation of the rapporteur's powers, as it reveals flaws and biases in the proposals adopted. Collegiality, in turn, has been understood as an institutional quality of the courts, which adds advantages and positive effects to the functioning of the courts and the collective decision-making process and, therefore, cannot be understood so simplistically as the proceduralists seem to do. Moreover, based on the premise that formal rules and procedures are insufficient to explain the functioning of the courts, a portrait of the Brazilin Supreme Court and the performance of its ministers as rapporteurs was constructed through the combination of reports and analyzes. qualitative and quantitative, and under an institutional bias, which reveals an increase in the rapporteur's powers accompanied by individual behavior that exploits these powers to produce direct effects on the political process and the status quo, as well as other problems that contrast with premises and pretensions of the discourses that supported the procedural reforms. In the end, by combining all these perspectives and elements, a critical analysis of these procedural managerial reforms was established, especially about the extension of the rapporteur's powers, and from this new perspective the effectiveness of these legislative changes and some of its implications were verified.
