A Lei n. 12.349, de 15 de dezembro de 2010, inseriu no artigo 3º da Lei das Licitações o objetivo de "promoção do desenvolvimento nacional sustentável". Entende-se classicamente que a sustentabilidade possui, no mínimo, três dimensões: ambiental, social e econômica. A despeito de sua relevância, o aspecto social tem sido pouco explorado pela doutrina nacional. Diante disso, a presente pesquisa se dispôs a analisar quais são, como funcionam e o que objetivam os mecanismos de contratação pública socialmente sustentável existentes na legislação nacional brasileira. Para tanto, inicialmente promoveu-se um estudo acerca das características da função de fomento dos contratos públicos e da sustentabilidade sob o viés social. Com base nos parâmetros estabelecidos, foi realizado um levantamento legislativo visando mapear os mecanismos de direcionamento da contratação pública para o atingimento da sustentabilidade social existentes. Posteriormente, os mecanismos foram analisados individualmente, agrupados pela fase da contratação em que produzem efeitos. Ao final, o trabalho definiu "contratação pública socialmente sustentável" e enfrentou os principais desafios e críticas relacionados ao tema, concluindo que o instituto tende a se perenizar e aperfeiçoar, não configurando apenas uma moda passageira no direito administrativo brasileiro.

Law 12.349, from December 15th, 2010, inserted in article 3 of the Law 8.666/1993 the objective of "promoting sustainable national development". It is classically understood that sustainability has at least three dimensions: environmental, social and economic. In spite of its relevance, the social aspect was left aside by the national doctrine. This research aims to analyze what the mechanisms of socially sustainable public procurement in the Brazilian national legislation are, how they work and what are their goals. In order to do so, at first a study was carried out on the characteristics of the function of promotion in public procurement, as well as on the sustainability in its social aspect. Based on the established parameters, a legislative survey was carried out aiming to map the mechanisms for directing public procurement to achieve social sustainability. Subsequently, the mechanisms were analyzed individually, grouped by the contracting phase in which they produce effects. In the end, the work defined "socially sustainable public procurement" and faced the main challenges and criticisms related to the subject, concluding that the institute tends to perpetuate and be optimized, not characterizing just a passing fad in Brazilian administrative law.
