Este trabalho visa analisar a Sociologia Jurídica de Boaventura de Sousa Santos sob a perspectiva da Sociologia Ambiental do Direito, teorizada por Marcio H. P. Ponzilacqua, a fim de constatar se é possível reconhecer os elementos caracterizadores primordiais de uma perspectiva ambiental no pensamento jurídico-sociológico de Boaventura. Para tanto, parte-se da premissa de que a racionalidade moderna se ampara numa polarização dicotômica que contrapõe a Humanidade e a Natureza. Assim, a expansão capitalista e a conversão do conceito de progresso em desenvolvimento econômico transformaram os recursos naturais em bens consumíveis, precificáveis e passíveis de comercialização. Nesse contexto, a exploração ecológica, amparada na lógica capitalista da maximização de lucros se torna insustentável, o que resultou na crise ecológica contemporânea e nos conflitos socioambientais dela decorrentes. Diante dessa realidade, a perspectiva dos direitos socioambientais ganha relevo ao defender a promoção da -Justiça Ambiental? através da busca por alternativas jurídico- sociológicas capazes de superar as vulnerabilidades que permeiam tais conflitos. Nesse contexto, a presente dissertação visa resgatar a importância do reconhecimento da interdependência entre Humanidade e Natureza na análise jurídico-sociológica dos conflitos socioambientais, reconhecendo a complexidade e intersubjetividade a eles inerentes e, no entanto, ignorada pela perspectiva excessivamente economicista empregada pela maioria dos sociólogos do direito. Assim, confronta-se a obra do pensador português Boaventura de Sousa Santos com a -Sociologia Ambiental do Direito?, teorizada por Marcio H. P. Ponzilacqua, visando-se reconhecer os elementos caracterizadores primordiais de uma sociologia jurídico- ambiental na sociologia jurídica de Boaventura. Por fim, concluí-se pelo reconhecimento de uma Sociologia Ambiental do Direito boaventuriana, da qual, inclusive, é exemplo a oposição popular à nova política nacional de agrotóxicos aprovada na Câmara dos Deputados do Brasil.

This research aims to analyze the Legal Sociology of Boaventura de Sousa Santos from the perspective of the Environmental Sociology of Law, theorized by Marcio H. P Ponzilacqua, in order to verify if it is possible to recognize the primordial characterizing elements of an environmental perspective in the Boaventura's legal-sociological thinking. To this end, we start from the premise that modern rationality rests on a dichotomous polarization that opposes Humanity to Nature. Thus, capitalist expansion and the conversion of the concept of progress into economic development transformed natural resources into consumable, priced, and tradable goods. In this context, ecological exploitation, based on the capitalist logic of profit maximization, becomes unsustainable, resulting in the contemporary ecological crisis and the resulting social and environmental conflicts. Given this reality, the perspective of social and environmental rights is highlighted by advocating the promotion of "Environmental Justice" through the search for legal and sociological alternatives capable of overcoming the vulnerabilities that permeate such conflicts. In this context, the present dissertation aims to rescue the importance of recognizing the interdependence between Humanity and Nature in the juridical-sociological analysis of socioenvironmental conflicts, recognizing the complexity and intersubjectivity inherent to them and, however, ignored by the excessively economist perspective employed by most sociologists of Law Thus, the work of the Portuguese thinker Boaventura de Sousa Santos is confronted with the -Environmental Sociology of Law?, theorized by Marcio H. P. Ponzilacqua, in order to recognize the primordial characterizing elements of a legal-environmental sociology in the Boaventura's legal-sociology. Finally, it was concluded by the recognition of an Boaventurian Environmental Sociology of Law, which is an example, even popular opposition to the new national pesticide policy approved in the Brazilian Chamber of Deputies.
