O presente trabalho tem como problema de pesquisa o seguinte questionamento: a partir do contexto intersetorial do Projeto "Políticas públicas para crianças e adolescentes em situação de rua de Ribeirão Preto - SP", a judicialização da política pública com foco no estabelecimento de fluxos de atendimento para crianças e adolescentes em situação de rua mostra-se uma via adequada para a efetivação de direitos desse grupo? Este problema de pesquisa foi definido com base em um estudo de caso realizado no formato de pesquisa participante que permitiu trazer ao debate a questão da intersetorialidade como um elemento da política pública para a efetivação de direitos de um grupo de crianças e adolescentes acentuadamente vulnerabilizado, questionando a judicialização enquanto via adequada para a efetivação de direitos. Alicerçado no objeto de estudo de caso, qual seja, o Projeto "Políticas públicas para crianças e adolescentes em situação de rua de Ribeirão Preto - SP", foi estabeleci como objetivo geral analisar a adequação da judicialização da política pública para crianças e adolescentes em situação de rua, no Município de Ribeirão Preto - SP, no contexto do Projeto. Em relação aos objetivos específicos, estes são: a) realizar uma revisão bibliográfica sobre crianças e adolescentes em situação de rua, intersetorialidade e elaboração e judicialização de políticas públicas, a fim de analisar a questão sob uma ótica multifatorial; b) efetuar um levantamento sobre os marcos normativos relativos a crianças e adolescentes em situação de rua em âmbito nacional, estadual e municipal, para a organização de um arcabouço legal capaz de subsidiar a análise de uma política pública que esteja dentro dos parâmetros legais; c) e analisar, a partir de um contexto intersetorial, a adequação da judicialização da política pública com foco no estabelecimento de fluxos entre serviços para o atendimento de crianças e adolescentes em situação de rua. Enquanto metodologia, a escolha deu-se por estudo de caso no formato de pesquisa participante com a utilização das técnicas da análise de conteúdo para a descrição, inferência e interpretação dos documentos selecionados, quais sejam: a documentação relativa ao Projeto e ao diário de campo elaborado ao longo do desenvolvimento da pesquisa e da participação no Projeto. Sem pretensões de apresentar respostas irrefutáveis, o presente trabalho busca explorar tensionamentos no que diz respeito à própria compreensão de crianças e adolescentes em situação de rua, considerando-os grupo titular de direitos coletivos; à invisibilização desse público para o Direito, seja este considerado em sua dimensão prática ou acadêmica; aos desafios e potencialidades da intersetorialidade enquanto elemento da política pública; e, por fim, à adequação da judicialização da política pública para garantir direitos desse público infanto-juvenil, o que, em última instância, intersecciona-se ao tensionamento relativo à capacidade do Poder Judiciário em garantir direitos a grupos vulnerabilizados.

This paper has as research problem the following question: from the intersectoral context of the Project "Public Policies for children and adolescents in street situation in Ribeirão Preto - SP", the judicialization of public policy with a focus on establishing care flows for children and adolescents in street situation is an appropriate way for the realization of rights of this group? This research problem was defined based on a case study carried out in the format of participant research that allowed the debate on intersectoriality as a public policy element for the realization of the rights of a group of children and adolescents who are markedly vulnerable, questioning judicialization as an appropriate way to realize rights. Based on the case study object, which is the Project "Public Policies for children and adolescents in street situation in Ribeirão Preto - SP", it was established as a general objective to analyze the adequacy of judicialization of public policy for children and adolescents in street situation in Ribeirão Preto - SP, in the context of the Project. Regarding the specific objectives, these are: a) conduct a literature review on children and adolescents in street situation, intersectoriality and public policy making and judicialization, in order to analyze the issue from a multifactorial perspective; b) carry out a survey on the normative frameworks regarding children and adolescents in street situation at national, state and municipal levels, for the organization of a legal framework capable of subsidizing the analysis of a public policy that is within the legal parameters; c) and analyze, from an intersectoral context, the adequacy of the judicialization of public policy with focus on the establishment of flows between services for the care of street children and adolescents. As methodology, the choice was given by case study in the format of participant research with the use of the techniques of content analysis for the description, inference and interpretation of the selected documents, namely: the documentation related to the Project and the field diary prepared throughout the development of the research and the participation in the Project. Without pretensioning to present irrefutable answers, the present work seeks to explore tensions regarding the understanding of children and adolescents living on the streets, considering them as a group holding collective rights; the invisibilization of this public for the Law, whether considered in its practical or academic dimension; the challenges and potentialities of intersectoriality as an element of public policy; and, finally, the adequacy of the judicialization of public policy to guarantee rights of this public, which, ultimately, intersects with the tensioning related to the capacity of the Judiciary to guarantee rights to vulnerable groups.
